미국 뉴욕주의 기후변화에 대한 법적 대응전략과 시사점

2015년 12월 미국 오바마 대통령은 파리기후변화협정(Paris Conference of Parties of the United Nations Framework Convention on Climate Change, UNFCCC)에, ‘미국은 2020년까지 이산화탄소 배출을 2005년 대비 17% 감축하겠다’는 약속(commitment)을 하고, “26∼28% 감소를 ‘국가별 자발적 감축목표(Intended Nationally Determined Contributions, INDC)’로 하여, 28% 감소를 위해 최선의 노력 (best efforts)을 다하겠다”는 서약서를 제출했었다. 그런데, 2017년 5월 트럼프 대통령이 대통령령(Executive Order)으로 파리기후변화협정 서명시 제출한 미국의 서약서를 이행하지 않겠다고 선언하자, 6천8백만을 대표하는 388개 미국 도시의 시장들이 ‘세계는 더 이상 기후변화가 진행되도록 기다릴 수 없고, 그들도 더 이상 기후변화에 대응하는 것을 기다리지 않겠다’는 선언으로, 트럼프의 기후변화 정책에 반기를 들었다. 51개주로 구성된 미국의 경우 기후변화의 영향은 주마다 다르게 나타나고 있다. 캘리포니아주를 비롯한 서부 주들의 경우, 가뭄의 장기화와 심각한 물 부족현상이 나타나고, 뉴욕주를 비롯한 동부 주들의 경우 태풍, 혹한, 기습적인 폭우의 증가가 나타나고 있다. 뉴욕주는 지리적 환경적 조건에서 한국과 유사하고 활발하게 기후변화 대응을 위한 구체적인 법제와 정책들을 실행하고 있다. 본 소고는 2장에서 뉴욕주의 기후변화 대응법인 ‘뉴욕주 기후 및 지역사회 보호법’ 제정 전후 뉴욕주의 기후변화 정책들을 비교하고 마지막으로 뉴욕주의 기후
Abstract
The US consists of 50 states and the climate change impacts are different from state to state. The western states including California suffer with a longer period of draught and serious lack of water, and the eastern state including New York suffer storms, extreme cold, and increase of sudden rainfalls. Among many states of the US, the State of New York is one of the most enthusiastic state to lead the climate change action and to have performed aggressive counter climate change laws and policies. New York is also very similar to the Republic of Korea in terms of geographical and environmental aspects. This article introduces the climate change laws and policies of New York State, to propose some suggestions for the Korean climate change regime. Part II explains the New York Climate and Community Protection Act, which is the main law to respond to the climate change in New York State, and compares the climate change policies before and after the above New York Climate and Community Protection Act. The last part concludes with several suggestions for the Korean climate change regime from the experiences of the State of New York.
