민주주의의 질적 심화와 개헌의 방향: 경성헌법주의를 넘어서

초록
1987년 민주화와 함께 도입된 이래 30년째 지속하고 있는 9차 개정헌법에 대한 개헌 담론이 한창 진행 중이다. 문재인 대통령은 대선 공약으로 2018년 지방선거와 동시 개헌을 내걸었으며, 20대 국회에는 30년 만에 헌법개정특별위원회가 구성되어 활동 중에 있다. 현 시점에서제도적 현실적 제약으로 6월 지방선거와 동시 개헌은 불가능할 것으로 보이지만, 많은 조사결과들에 따르면 정치 엘리트들 사이에서 뿐만 아니라 일반 시민들 사이에서도 개헌에 대한관심이 여전히 높은 것으로 나타나고 있다. 2017년의 평화적 촛불혁명 그리고 헌정 사상 초유의 민주적 절차에 따른 현직 대통령 탄핵은 동시대를 살아가고 있는 우리 시민들의 정치적의식수준이 상당 수준에 이르렀음을 보여주고 있다. 본 논문은 민주주의의 질적 심화의 관점에서 개헌의 필요성을 진단하고, 민주주의와 입헌주의의 조화라는 관점에서 개헌의 절차와 방향을 제시해보고자 한다. 특히, 우리 사회의 민주주의가 질적으로 심화에 감에 따라 정치의 사법화 현상 등 입헌주의와 민주주의 간 긴장과 갈등이 빈번하게 관측되게 되었는데, 본 논문은이러한 갈등 문제를 풀기 위한 한 방안으로 헌법 개정 이슈를 살펴본다. 헌법 개정 방향에관련하여 본 논문은 비교적 시각에서 경성헌법주의의 완화 필요성을 제기하고, 개헌 이후 민주주의의 질적 제고를 위한 개정 방법을 제안하며, 나아가 개헌이 초래할 정치사회적 비용을최소화하기 위한 방안을 논의한다.
Abstract
Discussions is in full swing in Korea regarding the revision of the Constitution of the 9th Amendment, which has been ongoing for 30 years since its introduction in 1987 with democratization. There is a greater interest than ever before in constitutional amendments in Korea among the general public as well as political elites. If the goal of democratization was to establish the rule of law, as democracy develops, we often see conflict and tension between democracy and rule of law especially through the judicialization of politics. This paper evaluates the necessity of amendment from the perspective of deepening of democracy in Korea and suggests the procedure and direction of amendment in terms of harmony of democracy and constitutionalism. In particular, we suggests amendment method to improve the quality of democracy after the amendment including the relaxing the rigidity of the constitution, and discusses ways to minimize the political and social costs caused by the amendment.
