「WTO협정」 헌법화에 대한 서론적 고찰 ― 분쟁해결에 대한 논의를 중심으로 ―

초록
연구의 목적은 ‘국제법의 헌법화’의 일환으로 발생하고 있는 ‘「WTO협정」의 헌법화’에 대한 재조명이다. 이러한 재조명은 「WTO협정」의 헌법화의 연혁, 의의 및 필요성에 관한 고찰에서 시작하여 궁극적으로 「WTO협정」의 헌법화가 국제경제법질서에 가져오는 중요한 기능과 역할에 대해서 연구이다. 따라서 서론에서는 ‘국제법의 헌법화’의 의의 즉 국내헌법의 영향이 국제적으로도 전개되는 ‘헌법화’의 의미에 대한 정의를 시도한다. ‘헌법’과 ‘헌법화’의 개념의 정의에서 부터 고찰해야 하는 ‘국제법의 헌법화’와 ‘「WTO협정」의 헌법화’의 의의에 대해서는 아직 국제법 학자들 사이에 합의된 바가 없기에 의미가 있는 시도라고 본다. 본론에서는 「WTO협정」의 헌법화의 기능과 역할에 관한 연구를 위하여 그러한 헌법화가 WTO에 전반적으로 미치는 효력에 대한 분석을 한다. 그리고 「WTO협정」의 헌법화가 진행되고 있다는 중요한 증거가 되는 두 개의 WTO의 분쟁사례인 European Communities-Customs Classifications Case 사건과 Mexico-Measures Affecting Telecommunications Services 사건에서 항소법원과 패널의 결정을 분석한다. 이러한 연구는 「WTO협정」의 헌법화로 분쟁해결제도의 법적기능의 활성화라는 효과뿐만 아닌 WTO가 마주하고 있는 오늘날의 난제들에 대해 제시하는 긍정적인 영향과 해결책을 찾는 것에 기여하기 위함이다.
Abstract
The Appellate Body of WTO concluded to confer the legal status of constitutional law to WTO Law through the jurisprudence of European Communities-Customs Classifications Case. This manner of regarding the WTO Law as the constitutional law enables the WTO DSU system to stick to ‘Textualism’ in interpretation. In Mexico-Measures Affecting Telecommunications Services, the panel brought the lens of ‘right-based constitutional theory’ in interpretation. The panel’s jurisprudence is also estimated as bringing the constitutionalization of WTO Law because the interpretation based on ‘right-based constitutional theory’ ultimately brings the consumer-oriented interpretation to the producer-oriented interpretation of WTO system. Likewise, the constitutionalization of WTO Law changes WTO system into the organization of protecting such fundamental principles contained in domestic constitutional law as rule of law, democracy, the distribution of power, the protection of fundamental rights of citizens. It is evident that the constitutionalization of WTO Law has to be materialized to continue the trade in a sustainable manner.
