롤즈의 만민법과 한반도 ‘평화와 인도주의 연합’

Rawls' The Law of Peoples contains important principles that should be seriously considered in the international community as well as the Korean peninsula issue. The Law of Peoples covers the regulatory principle of ‘realistic utopia’, which encompasses the international relations theory of realism and liberalism, as well as serves as a normative reference for the prospective Korean Union. This paper is divided into two parts. The first part is to analyze the principles of The Law of Peoples from the perspective of ‘Peace and Humanitarian Union’. I will focus on the coexistence and tolerance between different regimes, the prohibition of hostilities and aggression, and the minimum human rights and humanitarian assistance for disadvantaged societies. I do not simply follow Rawls' position. In particular, I refer to the conservativeness of Rawls, including the approval of nuclear weapons in the matter of war and peace, and the limitations of humanitarian relief in the issue of foreign aid. The second part of this paper is finding a solution to the problem of the Korean peninsula from the perspective of ‘Peace and Humanitarian Union’. The prospective vision of unification on the Korean peninsula is to be sought from the perspective of ‘South-North Peace and Humanitarian Union’. I tried to think of the reunification of the two Koreas from the viewpoint of the union, not the absorption by either side, and peace and humanity, not just national homogeneity. Specifically, we tried to suggest the tolerance and coexistence of different regimes, the conclusion of a peace treaty, the denuclearization, the reduction of standing armies, the common basic human rights, and humanitarian assistance and development cooperation.
