도시공원 결정에 필요한 조정 보상 방안 연구

도시공원은 도시지역에서 도시자연경관을 보호하고 시민의 건강･휴양 및 정서생활을 위하여 이용되는 필수불가결한 요소로서, 도시･군계획시설인 도시공원시설과 용도구역인 도시자연공원구역으로 결정된다. 도시공원 결정에 따라 토지를 종래의 목적으로 사용할 수 없거나 사적 이용가능성이 불가능한 경우에는 사회적 제약의 한계를 넘는 것으로 보아야 한다. 다만, 도시공원의 결정은 지방자치단체의 사무에 해당하는데, 열악한 지방자치단체의 재정 상태를 감안하여 볼 때 도시･군계획시설 가운데 가장 넓은 면적을 차지하는 도시공원시설의 설치는 불가능한 실정이다. 또한, 도시기능을 고려하여 볼 때 도시･군계획시설을 단순히 해제하기도 어렵다고 할 것이다. 이러한 딜레마(Dilemma)를 해결하기 위하여 정부 및 국회는 도시자연공원구역제도를 새롭게 도입하였다. 그런데 도시자연공원구역은 도시공원시설의 집행 또는 실효에 대한 신뢰보호의 문제, 도시자연공원구역 지정에 따른 완화 조치로서 도입된 매수청구권에 대한 비례성 문제, “공원녹지법”상 협의에 의한 토지 매수 규정에 대한 체계정당성 문제가 있다. 따라서 도시공원 결정을 위해서는 도시자연공원구역 지정의 자제를 통한 신뢰보호, 매수청구권 행사 요건 완화･주민지원사업･세금 감면 등을 통한 비례성 회복, 협의에 의한 토지 매수제도 개선을 통한 체계정당성 확보 등의 조정 보상이 필요하다.
Abstract
The urban park are built or designated to contribute to protecting urban natural scenery and improving health, recreation, and aesthetic sentiments of citizens in urban areas; determined by urban or Gun management plans of urban park facilities and urban natural park areas. If the land can not be use for a conventional purpose or the possibillity of private use is impossible according to urban park determined by urban or Gun management plans, it should be regarded as exceeding the social limit. however, determination of urban park is authority of local government, and considering the poor financial status of local governments, it is impossible to build the urban park facilities which occupy the widest area among the urban or Gun planning facilities. Also, considering the urban functions, it would be difficult to simply release of the Gun planning facilities. To solve this dilemma, the government and the National Assembly have introduced a new urban natural park areas system. 「Act on urban parks, green areas, etc」 has the problems of the principle of protection of legitimate expectation in the implementation or invalidation, the principle of proportionality in claims for land purchase to introduce as a mitigation measure according to the designation of urban natural park areas, the principle of system legitimacy in purchase of lands through consultation. Therefore, in order to determin urban parks, it is necessary to introduce mediative compensations such as the restraint of designation of urban natural park areas, alleviate claims for land purchase, resident support projects, tax cut, etc. and improve purchase of lands through consultation.
