Kingdon의 다중흐름모형을 통한 정책결정과정 분석 연구 - 부정청탁 및 금품 등 수수의 금지에 관한 법률을 중심으로

초록
본 연구는「부정청탁 및 금품 등 수수의 금지에 관한 법률」이 제정되는 과정을 Kingdon의 다중흐름모형(MSF)을 적용해 정책결정과정의 흐름별 특성과 함께 상호관계, 영향력 여부 등 연계 구조를 탐색하고, 정책결정과정에서의 주요 요인 등 이 법안의 제정과정에 나타난 특징과 정책적 함의를 도출하였다. 첫째, 공직사회의 비위에 대한 사회 환경적 요인이 정책문제흐름과정을 형성해 정책결정에 큰 영향을 미치고 있으며 둘째, 국민권익위원회 등 해당 정부부처의 적극적인 정책형성 활동이 정책대안흐름을 통해 정책결정을 촉진했다. 셋째, 정치흐름과정을 통해 국회라는 정치집단의 영향력을 재확인하게 되었으며 넷째, ‘정책의 창’을 열고 ‘정책산출물’을 도출하는데 ‘정책혁신가’의 역할이 중요함을 살펴봄과 동시에 ‘정책혁신가’의 역할은 조정과 중재역할이 우세하여 ‘정책혁신가’라는 표현보다는 ‘정책중개인’이적합하였다. 다섯째, 법안이 형성되는 결과를 통해 ‘쓰레기통모형’의 특징인 ‘진빼기 결정’을 확인할 수 있어 다중흐름모형이 ‘쓰레기통모형’에 기반을 두고 있다는 이론적 배경의 근거도 확인할 수 있었다. 끝으로 Kingdon은 흐름별 결합여부에 따라 열리는 ‘정책의 창’ 종류가 정해져 있다고 했지만, 정책 사례에 따라 흐름별 결합여부가 달라질 수 있다는 차이점을 발견한 점은 본 연구의 의의라 할 수 있다. 분석결과에 따른 정책적 함의로서 정책결정을 위한 형성기에는 해당 정부부처의 적극적인 대응이 절실하며, 아울러 정책결정과정에서 필연적으로 대두하는 이해관계자 사이의 갈등을 최소화하고 정책결정을 안착시키기 위해서는 시기별 조정 및 중재자로서의 행동이 기대되는 ‘정책중개인’의 역할이 중요하다는 점을 고찰하였다.
Abstract
In this research, we derive the features and policy implications that appeared in the enactment process by applying Kingdon's Multiple Streams Framework (MSF) to the process of enacting "laws concerning prohibition of solicitation and prohibition of gifts, etc.".
