미래시대 농업・농촌을 위한 법적 과제

초록
미래시대 미래 농업・농촌은 지금과는 다른 모습이 될 것이다. 먼저 제4차산업혁명 등 과학기술의 발달은 공유경제, 바이오기술과 결합하여 농업・농촌분야에서 선도적으로 응용이 되고 있는데 급속히 보편화될 것이다. 또한 농업은 전통적인 의미의 농림수산물 생산업(1차산업)에서 농림수산물을 원료로 하여 만든 식품・의약・제조업 등 제2차산업, 그리고 농촌관광・힐링・서비스업등 제3차 산업까지 함께 융・복합된 산업, 즉 제6차 산업(1차*2차*3차 산업)이될 것이다. 이에 따른 법적 과제는 농업농촌 관련 법(이른바 ‘농업법’)의 새로운도전이 되고 있다. 이러한 농업・농촌분야의 미래 이슈는 농지나 농업용 시설의 전통적 정의를무너뜨리기도 하고(식물공장), 농업인과 농업활동을 재정의할 필요를 양산한다. 지능형 로봇은 로봇에 대한 법인격 부여 문제, 로봇과 농업인의 경계를 모호하게 하고, 사고가 났을 경우 법적 책임, 유전자변형 생명체(GMO)나 로봇 등에관한 제조물 책임 등 소비자 보호를 어떻게 할 것인가와 같은 법적 과제도 시급하다. 한편 농업・농촌과 관련된 법영역은 공법뿐만 아니라 사법도 걸쳐 있어서(예, 농지법), 공법적 제재와 더불어 사법적 규율이 상호 보완된다면 다양한 산업관계자(농업인-소비자-유통업자, 정부 등) 간 분쟁 해결에도 도움을 줄수 있다. 요컨대 미래 농업・농촌에서 제4차 산업혁명과 6차산업화는 우리에게 위협요인이자 기회요인이 될 수 있다. 불합리한 규제는 개혁해야 하지만 농촌다움(amenity)이나 안전을 위한 꼭 필요한 규제는 신설해야 한다. 아울러 규범 수범자의 명확한 보호를 위해 농업인 정의를 포괄적 정의방식으로 또한 기능주의관점에서 새롭게 해야 하며, 세제상 사각지대를 없애고 공평한 과세 또는 세제지원을 위해 농업활동에 대한 유연한 정의도 필요하다.
Abstract
Agriculture in the future will be expanded from traditional agricultural, marine and fisheries production industries (primary industry) to agriculture, forestry and marine products food and medicine manufacturing industries and rural tourism healing services Industry (the 6th industrialization = primary * secondary * tertiary industry). In addition, the shared economy, biotechnology, and the 4th Industrial Revolution are leading applications in agriculture and rural areas, resulting in various legal challenges. These future issues will undermine traditional definitions of farmland (plant factories), the issue of legal entities for intelligent robots, the need to redefine farmers by blurring the boundaries between robots and farmers, There is a pressing need for a variety of legal reviews, such as the issue of consumer protection, how GMOs and robots are responsible for product liability, and so on. In the meantime, the law area related to agriculture and rural areas is not only public law but also legal field (for example, farmland law), and various industrial people (farmers - consumers - distributors, governments, etc.) It can also help. In short, the 4th industrial revolution and the 6th industrialization in the form of future agriculture and rural areas are threats and opportunities for us. Unreasonable regulations should be reformed, and necessary regulations for safety and amenity should be established. In addition, for the protection of policy makers, farmers' definition should be renewed from the point of view of comprehensive definition and functionalism, and flexible definition of agricultural activities is needed to eliminate the blind spot in taxation and to support fair taxation.
