성폭력 범죄자의 피해자 선택

초록
본 연구는 범죄자의 입장에서 범죄자가 피해자를 선택하는 기준 또는 선택의 순간 고려하는 요소들을 살펴보고자 한다. 이를 위해 2회 이상의 성범죄를 저지른 성폭력 범죄자 22명을 대상으로 한 면접자료 중 피해자 선택을 나타내는 단서들을 추출하여 개방코딩한 후, 이를 추상화하여 범주화하여 분석하였다. 피해자에 대한 접근 방법은 ‘술을 통한 상호작용’, ‘놀이 등을 통한 상호작용’, ‘유흥업소 여성 선택’, ‘피해자 집 침입’, ‘무작위 선택’으로 구분되었다. 각각의 유형에서 가장 중요한 피해자 선택의 계기는 외모나 옷차림 등과 같은 피해자의 특성이 아니었다. 그보다는 피해 여성이 혼자 있는 상황, 침입하기 용이한 상황, 피해자를 쉽게 제압할 수 있는 상황 등 범행당시의 상황에 따라 범행대상을 선택하는 경향이 있었다. 이러한 결과는, 성폭력 피해자들에 대한 가장 심각한 2차 피해중 하나인 성폭력 발생의 책임 일부를 피해자에게 전가하는 현상을 비판할 수 있는 실증적 증거가 될 수 있을 것이며, 성폭력 범죄 예방 정책, 성폭력 피해자 보호 정책 등 다양한 영역에서 실천적 함의를 가질 수 있을 것이다.
Abstract
This study researched the criteria that criminals select victims from their perspective, or the factors that consider the moment of selection. For this research, 22 sexual offenders who committed more than one sex crime were interviewed. And among the interview contents, clues indicating the victim selection were extracted, and analyzed. The type of approaches to victims were ‘interactions through alcohol’, ‘interaction through play’, ‘selecting women in adult entertainment establishments’, ‘invasion of victims’ house’, ‘random choice’. The most important trigger for selecting victims for each type was not their traits, such as appearance or clothing. The situation at the moment of the crime were more important, such as ‘the victim was alone’, ‘Ease of intrusion’, ‘Ease of controling victims’. These results could be a valid empirical evidence of criticism against the responsibilities on sexual violence victims that one of the most serious secondary injuries for victims. The study also has practical implications in various areas, including policies to prevent sexual crimes and protect victims of sexual violence.
