통일한국의 미래와 헌법재판소의 기능과 역할-헌법이념과 위상 정립을 중심으로-

A unified Korea of the future should implement such universal values of humanity as freedom, equality, democracy, welfare, and justice for all Koreans. Therefore, the constitution of the unified Korea must contain constitutional values and liberal democratic order pursued by the members of South and North Korean communities. The social and cultural divide between two Korea that has accumulated for the past 70 years call for the constitutional court to play integral roles in resolving conflicts of various constitutional matters arising in the process of integration and ushering in an era of national unification. North Korea does not have a constitutional adjudication system equivalent to the constitutional court of South Korea. To open a path to the unification of Korean Peninsula with South Korea taking initiative, we need to define the status of the constitutional court more than anything else consistent with the future identity of the unified Korea. The future identity of the unified Korea is a national community founded on liberal democracy and market economy where universal values are respected and decent life is guaranteed. To resolve various social conflicts that will accompany the integration of two Koreas, constitutional ideology and the status of constitutional court for the unified Korea should be suggested appropriately.
