국제법평론회가 만들어진지 올해로 20년이다. 하지만 학술잡지 『국제법평론』은 1993년 9월에 이미 창간되었고 5년 후 창설된 국제법평론회가 통권 제10호부터 『국제법평론』을 발행하게 되었다. 따라서 국제법평론회의 연륜은 20년이지만 『국제법평론』의 연륜은 25년에 이른다. 그 동안 헤아리기 힘들 정도로 많은 연구논문들이 『국제법평론』의 지면을 장식하여 왔는데, 25년의 세월은 이 학술지에 게재된 연구 성과를 되돌아보고 정리하기에 적절한 기간으로 보인다. 이 글에서는 특히 국제법의 일반이론에 대해서 그 동안 게재된 논문들을 살펴 볼 예정이다. 하지만 일반이론은 그 의미 자체가 한 마디로 정의하기 힘들기 때문에 검토 대상 논문을 한정하는 것이 쉽지 않다. 일단 여기에서는 국제법의 모든 하부 주제들에서 공통적으로 적용 가능한 또는 논의 가능한 이론으로 줄이되, 이 또한 충분히 한정적이지 않으므로 국제법의 법원(法源)과 주체에 대한 논의로 인위적으로 좁힌다. 그리고 이 글은 기존의 논문들을 정리한 것이므로, 아래에서 소개된 학문적 견해나 표현의 대부분은 검토대상인 논문으로부터 나온 것이며 필자 본인의 의견이나 표현은 자제하였다.
Abstract
The Korea International Law Review(KILR) has been published since 1993. The time span of 25 years seems to be long enough to examine what has happened so far. This paper examines the academic papers, published in the last 25 years, which deal especially with the sources of, and the subjects of, international law. Researches on the traditional sources of international law, such as treaties and customary international law, are published. Also published are those on the newly emerging issue, such as soft law. Conflict of norms in international law also is carefully studied. Researches on the subjects of international law encompass States and non-State actors, such as inter-governmental organizations, NGOs and individuals. These academic papers show the developing interest of researchers in the current issues of international law and never fall behind the international academic trends. Nevertheless, developing and evolving academic concern to what is happening in the international community should be maintained lest that community be mere rhetoric.
