중국의 토지관리법상 토지소유권과사용권에 대한 이해

Understanding of ownership and use rights of land under China's Land Management Act

초록

China has achieved remarkable economic growth since it declared a policy of reform and openness focusing on the introduction of a capitalist economic system in 1978. It has grown to become an economic power that plays a part in the U.S. and the world economy. However, the government-led reform and opening policy has had a great impact on China's politics, economy, society and culture, one of which is the change in the land system. Such ownership system of land caused serious social and economic problems, including the economic gap between cities and rural areas and the problems of farmers who moved to cities, as well as the development of the Chinese economy. In other words, economic development exposed social problems, such as a shortage of land lots due to the concentration of population and a shortage of factory sites and construction sites for industrial development. In response, China seeks to reform its land system to solve these problems through efficient use of land within the socialist state system. It also has laws to back up the reform of the land system. In this paper, we look at land ownership and licensing under the Land Management Act and the methods of registering them. By doing so, it helps domestic companies and individuals seeking to enter the Chinese market, which has grown into a great market for goods and services, to expand their access to the Chinese market and strengthen bilateral economic cooperation. As we have seen so far, China still has a number of issues to tackle in order to use and manage land efficiently under the socialist land-sharing system. In order for China to lead the global economy through continuous economic growth, it should seek to utilize the rigid land through reform of the land system. These efforts will help attract foreign investors to China.
