준-대통령제에서 대통령의 헌법적 권한과 실질적 영향력: 하벨(V. Havel), 클라우스(V. Klaus), 제만(M. Zeman)의 대통령 권한 비교

초록
체코는 2012년 개헌으로 대통령 선출 방식을 의회 간선에서 직선으로 바꾸면서 명목상으로는 준-대통령제 국가가 되었다. 개헌으로 대통령 선출 방식만이 바뀐 것이 아니라 대통령의 권한도 일부 바뀌었는데, 직선으로 대통령의 정당성이 높아진 것과 반비례해 오히려 대통령의 헌법적 권한은 줄어들었다. 따라서 형식상으로는 준-대통령제가 되었지만 공식적 권한이라는 측면에서는 오히려 의회제가 강화되었다고 볼 수 있다. 그러나 체코 대통령의 위상과 권위에 대한 오랜 정치 전통과 특정 시기의 정치 불안정, 대통령의 개인적 야망 등으로 인해 체코는 형식적으로는 준-대통령제 국가 중에서도 대통령의 공식 권한이 가장 약해 의회제에 가깝지만, 실질적으로는 가장 강력한 대통령이 존재하는 모순적 상황에 처해 있다. 이런 사실에서 본문에서는 대통령에게 공식적인 권한이 거의 부여되지 않는 체코의 오랜 의회제 전통에도 불구하고 현실에서는 상당한 영향력을 발휘하고 있는 의회제 하에서의 대통령의 실질적 권한을 살펴보고, 1999년 개헌을 통해 준-대통령제 국가가 된 이후 헌법상의 권한 축소와 반비례해 오히려 더 커진 대통령 실질 권한을 비교할 것이다.
Abstract
After the constitutional amendment, by which the president would be elected by directly, the Czech Republic became a semi-presidential state. The President's legitimacy has increased due to the direct election, but the constitutional power of the president has decreased through the amendment. Therefore, though the Czech republic became semi-presidential state for form's sake, it can be said that it became pure parliamentalism in which the parliament has been strengthened in all but name. However, due to the long political traditions of the Presidents’ position and authority, political instability in certain periods, and the President's personal ambitions, constitutional power of the Czech President is the weakest among the semi-presidential states but he can exert the considerable influence on political life. In this context, the purpose of this paper is to explore what is real power of the president under the semi-presidentialism after the constitutional amendment in 1999. The second part of this paper, I’ll discuss what factors have made the Czech President more political and administrative powerful under the semi-Presidentialism.
