예방의 필요성과 양형상의 고려

초록
우리 형사절차에서 양형에 관하여 특별예방이나 일반예방의 필요성에 대한 본격적인 심리는 일반적으로 이루어지지 않고 있다. 그러나 적정한 양형을 위해서는 형이 책임에 상응해야 할 뿐만 아니라 범인의 재범위험성에 따른 특별예방의 필요성과 범행 유형에 따른 일반예방의 필요성에 대한 충분한 심리가 필요하고 그 결과가 형에 적정하게 반영되어야 한다. 특별예방의 필요성이 있다고 보기 위해서는 범인의 재범위험성의 정도가 평가되어야 하는데 이를 위해서는 해당 범죄의 내용뿐만 아니라 범인의 정신‧심리 상태, 범인의 범죄 전력을 포함하여 범행에 간접적인 영향을 미칠 수 있는 제반 요소에 대한 심리를 통해 범인에게 반사회적 성향이나 규범위반의 경향이 있는지를 파악해야 한다. 한편 일반예방의 필요성이 있다고 보기 위해서는 범인이 저지른 해당 범죄에 대한 형벌의 위하력이나 일반인의 규범의식에 미칠 영향력이 다른 범죄와 비교하여 유의미한 차이가 있는지에 대한 판단이 필요하다. 나아가 특별예방의 필요성과 일반예방의 필요성에 대한 심리 결과는 형종의 선택, 형의 선고나 집행 여부의 결정 또는 형량의 결정 등 문제되는 양형의 국면에 따라 형에 반영되는 정도가 달리 판단될 수 있다.
Abstract
In our criminal trial, the necessity of recidivism or crime prevention is not examined properly. Still, the fair determination of punishment is only possible through sufficient examination into the necessity of the prevention and reflection of the result as well as responsibility for crime in the punishment. We could recognize the necessity of recidivism prevention through assessing the risk of recidivism, which means the criminal might have antisocial personality or tendency of violating social rules. It is perceived through examination into not only the nature of the crime but also the mental state, criminal record, and various factors which could be related to the crime. Meanwhile, necessity of crime prevention should be considered if there is a meaningful difference between the crime committed and other crimes in terms of the possible influence that certain punishment has on general person. The reflection of the necessity of the prevention in punishment could differ according to the situation or stage of determining a punishment.
