인간대상연구에서 개인정보처리에 대한 고찰

In order to protect the rights and interests of research subjects in the study on human subjects, it is necessary to have the consent of the research subject. The consent is also needed in order to guarantee the right of the information subject to self-determination in the processing of personal information. All of the above consents must be informed consents, and the ability to consend, performance of explanatory obligations must be preceeded. Also, according to the Act on Bioethics and Safety, researchers must obtain written consent from human research subjects to have the subjects participate in the research. In this case, the written consent should include the provision about protection and offering of the subjects’ personal information. Therefore, consent to the processing of personal information is included in the research participation consent, and its format is limited to the written consent according to the research participation consent. If the research participation consent is exempted, it should be regarded as an exempt. The Personal Information Protection Act stipulates that it can not process the resident registration number even if the information subject has consent, and can handle the case where another law specifically requires or permits the processing of the resident registration number. Since the Article 2, subparagraphs 17 to 19 and the Article 16 of the Act on Bioethics and Safety should be regarded as a special provision to the Act on the Protection of Personal Information, the researcher can process the resident registration number with the consent of the human research subjects.
