공유자원 경계 분쟁해결 사례 연구: 제주특별자치도 마을어장 사례를 중심으로

본 연구는 마을어업의 경계를 둘러싸고 제주도에서 발생하였던 마을 간의 어장분쟁 발생원인과 이를 해결하는 과정에서 나타나는 양태를 분석하였다. 이 같은 분석을 통해서 향후 발생할 가능성이 있는 마을어장 경계분쟁의 해결방안을 제시하는데 본 연구의 목적이 있다. 본 연구는 1960년대 제주도에서 발생하였던 마을어장 분쟁 5개 사례를 통해서 다음과 같은 정책적 함의를 도출하였다. 첫째, 지역공동체 간의 분쟁에서 가장 바람직한 해결방안은 보충성의 원칙(principle of subsidiarity)에 근거하여 공동체의 문제를 해결하는 것이다. 지역공동체의 분쟁은 1차적으로 당사자 간의 합의를 시도하고, 이것이 이루어지 않을 경우 외부기관의 중재, 지방정부나 법원의 개입을 통해 해결하는 것이다. 둘째, 제도변경에 따른 기대이익의 상실에 대한 보완대책 없이 새로운 제도에 대한 순응을 강요하는 것은 정부의 불신 등을 초래하여 오히려 사회적으로 감당해야 할 비용이 더 크게 발생할 수도 있을 것이다. 이 같은 점을 고려하여 과거의 관행을 일정기간 존중해주는 조부조항(grandfather clause)을 적용하면서 새로운 제도의 적용을 확대해 나가야 할 것이다. 셋째, 분쟁을 해결하기 위하여 해당지역주민과 직능단체, 읍･면사무소, 군청, 도청, 경찰청, 수산업협동조합, 전문기술단체 등이 참여하는 Local Governance를 통해 분쟁의 해결책을 모색하는 것이다. 로컬 거버넌스는 자기지역의 문제를 지역구성원들이 스스로 해결하는 지방자치의 원리에도 부합하고 민주주의를 실천하는 과정이기도 하다.
Abstract
This study aims at figuring out the reasons of fishing boundary disputes and the process of dispute resolution between fishing villages in Jeju islands.. Five dispute cases that were happened in 1960s are analyzed to find how to reach the agreements between parties concerned. This study finds three policy implications. First, it is desirable that the disputes caused by fishing communities should be solved based on the principle of subsidiarity. The community dispute must be solved first between the communities concerned. If not, the conflict should be settled by outsider's arbitration, government intervention, or court ruling. Second, new system must be applied gradually for the groups who lose the expected profits from the changes of rules. In order to introduce a new rule smoothly, an old rule continues to apply to some existing situations while a new rule will apply to all future cases. Third, the dispute should be discussed by local governance where parties concerned, fisheries cooperatives, local government and civic groups take part in. Local governance accords with the principle of local autonomy and is a process of democratic practice.
