보험사기 실태 및 원인: 공모보험사기 사례를 중심으로

초록
보험은 각종 사고와 위험에 대비하기 위하여 현대사회에 없어서는 안 될 중요한 역할을 담당하고 있다. 자동차보험이나 건강보험은 예측할 수 없는 미래의 자동차사고나 질병 및 상해의 발생을 대비하는 것으로, 전 국민의 생활에 직접적인 영향을 미치고 있다. 보험제도가 발전하고 보장의 범위가 확대됨에 따라 보험을 이용한 범죄도 증가하고 있다. 보험사기는 보험회사를 상대로 부당이익을 취하기 때문에 직접적인 피해를 보는 개인이 없다는 점과 보험회사는 보험금 지급에 인색하다는 부정적인 인식으로 인해, 대다수의 보험사기 가해자들은 보험사기의 심각성을 간과하고 있는 것이 사실이다. 이러한 문제로 인해 최근에는 보험사기가 공모를 통하여 점차 조직화 되고 대형화 되고있는 추세이다. 따라서 본 연구에서는 보험사기에 대한 개념을 정의하고, 최근 일어난 공모를 통한 보험사기의 사례를 중심으로 실태를 파악하여 보험사기의 심각성을 논의해 보고자 한다. 또한, 보험사기 중 공모에 의한 보험사기의 원인을 살펴보고 형사법적인 대응방안에 대해서도 논의해 보고자 한다.
Abstract
In order to cope with various accidents and risks, insurance plays an important role in modern society. Automobile insurance and health insurance have a direct impact on the lives of all people, as they prepare for unpredictable accidents, diseases and injuries. As the insurance system develops and the scope of coverage grows, crime and fraud using insurance are also increasing. Because insurance frauders gain unfair profits from insurance companies that are perceived to be reluctant to pay insurance claims and no individuals directly suffer damages, it is true that majority of insurance frauders overlook the illegality of insurance fraud. Due to this problem, insurance fraud is becoming organized and the scale is getting larger through collusion. Therefore, in this study, we define the concept of insurance fraud and discuss the seriousness of insurance fraud by analyzing actual cases of insurance fraud through collusion. We will also examine the cause of insurance fraud in terms of criminology and discuss the criminal law approach.
