이슬람 상거래의 불공정 유형 분류 -한국의 공정거래법 관점을 중심으로-

초록
앞서 살펴본 바와 같이 본 논문은 서기 7세기 이슬람이 출현하면서 금지된 불공정거래 유형을 현대 한국사회의 불공거래법의 관점에서 분류했다. 우리의 공정거래와 이슬람의 공정거래가 크게 다르지 않으며 특히 7세기에 이슬람이 금지했던 불공정거래행위의 유형들은 현대의 우리 사회에서 쉽게 발견할 수 있는 유형과 매우 유사한 부분이 있음을 알 수 있었다. 이런 불공정거래행위를 근절하고 공정한 경쟁사회를 이루기 위해 양 쪽은 각각 샤리아와 와 공정거래법을 근거로 시장질서 유지를 추진한다. 시대적, 지리적 거리가 존재하고 있지만 현대 사회의 국가들과 7세기의 이슬람 사회는 모두 시장경제의 질서를 확립하고 유지하기 위해서 공정거래와 공정경쟁의 중요성을 인식하고 각자의 환경을 고려해서 제도적인 장치를 마련하고 시행하고 있다. 특히, 우리나라의 경우 급격한 산업화와 경제성장을 이루면서 이와 같은 제도적인 장치를 마련하기 보다는 성장에 우선 순위를 두었고 그로 인해 공정거래보다는 불공정거래가, 공정하고 자유로운 경쟁보다는 편법이 우리의 경제사회에 만연했었다. 현재 대한민국의 공정거래법이 구분하는 거래거절(1호)와 차별적 취급(2호)에 해당하는 초기 이슬람 사회의 불공정거래 유형을 발견하지 못한 것은 본 연구의 한계점이라고 인정해야 할 것이다. 그러나 현대 사회에서 대기업들이나 진행할 수 있는 부당한 지원행위(10호)에 대한 초기 이슬람 사회의 유형의 경우는 이슬람 시대와 현대 사회의 시장의 규모의 차이로 인해 초기 이슬람 시대에는 존재하지 않았던 것으로 판단된다. 현대 자본주의 사회에서 조차도 불과 130여년 전에서야 그 부당함을 인식하여 시정하기 시작했던 불공정거래행위 또는 불공정경쟁제한행위를 어떻게 이슬람 사회는 이미 1300여년 전에 법으로 행위의 금지를 규정하고 공정경쟁과 공정거래의 정신으로 시장을 관리할 수 있었을까? 이는 이슬람이 사회적 불평등을 척결하고 사회적 공정성(ʿadālah ijtimāʿiyyah اجتماعية عدالة) 실현을 최고의 덕목으로 간주하기 때문이다.
Abstract
In a country where capitalism is normally developed, when it crosses the stage of industrial capitalism and enters the stage of monopoly capitalism, the market is damaged by the appearance of monopolistic and unfair co-operation acts in each industry. Accordingly countries have implemented the Antitrust Act and the Competition Act to regulate or adjust certain economic activities and to correct the functions of market and to eliminate fair restricting competition acts or factors. However there was already this kind activities in the Arabian Peninsula in the 7th century since the appearance of Islam. Islamic law Sharīʿah has prohibited competition-restricted acts in order to maintain and manage the market order on the basis of the fairness. The objective of this article is therefore to discuss competition-restricted acts of the early Islamic era and the modern Korean society. This article aims to classify Islamic Unfair Transactions upon the view of modern Competition Law in South Korea in order to understand what kinds unfair transactions were operated in the Arabian Peninsula in the early Islamic Era.
