형법 제311조 모욕죄를 폐지하자는 목소리가 높아지고 있다. 모욕죄 폐지는 한국에서만의 현안이 아니다. 각국에서 모욕죄는 오랜 동안 많은 비판을 받아왔다. 인권과 인격권을 위협하는 도구이기 때문에 폐지 또는 개정되어야 한다는 논란에 시달려왔다. 최근 10여년 많은 나라에서 모욕죄를 폐지하거나 개정했다. 모욕죄를 강화하는 나라들도 있다. 역사적 기원을 따져볼 때 모욕법은 주로 왕실 일가나 정부 공직자, 국기 등 국가 상징물을 보호하기 위해 존재했다. 많은 국가들이 국가나 왕 또는 대통령에 대한 모욕을 형사처벌하는 법을 가지고 있는데 비해 한국은 국가모독죄를 오래 전에 폐지했다. 일견 모욕죄에 관한 한 선진국가인 것처럼 보인다. 그러나 그것은 겉모습일 뿐이다. 정부나 대통령, 공직자들을 보호하기 위한 모욕법이 없는 나라나 또는 모욕법 자체가 아예 없는 나라에서는 형사적 명예훼손법이 그 공백을 메우기 위해 활용된다. 한국이 그 대표적 나라라고 할 수 있다. 한국의 모욕법은 외국의 모욕법과 비교할 때 어떤 특징이 있는가? 한국에서는 모욕죄 폐지 여론이 강하게 일고 있는데 다른 나라들의 모욕법 상황은 어떤가? 과연 한국의 모욕죄가 세계에서 매우 드문 존재인가?
Abstract
There are growing demands to abolish the insult offence of article 311 of criminal law. Repealing the insult law is an hot issue in not only Korea but many countries. In most Western European countries, insult laws are being considered as legal anachronisms. As their historical origins suggest, insult laws usually exit to protect the government, public officials, royal families, and national symbols from oral and written expression that can offend their honor and dignity. Many countries have broader insult laws that protect any person from similar offenses. Korea abolished the contempt of state from the Criminal Code in 1975. In countries that do not have insult laws for presidential and governmental protection, criminal defamation actions are often used to fill the gap. Korea is the case. Numerous non-governmental organizations have taken strong positions against insult laws. How does the Korean insult law compare with the foreign insult laws?
