법교육 방안으로 예비교사들의 모의재판 실행 사례 탐색

초록
본 연구에서는 예비교사들이 모의재판 수업을 구성한 사례와 학습 자료를 제시하고, 이들의 수업 체험 후 인식한 모의재판 수업의 의미와 지도상의 유의점, 앞으로 적용하고자 할 때 유용한 시나리오 주제에 관해 살펴보았다. 모의재판 체험을 한 결과 법 관련 내용을 좀 더 구체적으로 명확히 파악하게 되고 재판 절차와 맡은 역할을 이해하게 되어 진로 선택이나 법 교육 측면에서 유용하다고 보았다. 또한 법과 관련하여 자신의 행동을 점검하는 기회로 삼을 수 있어 준법 교육에도 도움이 된다고 보았다. 예비교사들은 모의재판 수업을 위해 학습자 수준에 부합하는 적절한 시나리오를 선정하는 것이 중요하다고 제안하고 있다. 이에 따라 학생들의 학교생활이나 일상생활과 밀접한 사례를 선정하는 것이 효과적이며, 법 관련 내용과 재판 과정의 역할에 대해 안내하는 것이 필요하다. 이러한 모의재판 수업을 법교육 방법으로 적극적으로 활용하기 위해서는 법과 재판 전문 집단에 의해 다양한 시나리오 사례들이 개발되어 학교현장에 보급될 필요가 있다.
Abstract
This study presented a mock trial case with mock trial learning material, investigated meanings of the mock trial as law-related education method, and examined attention points and useful scenario subjects. After mock trial experiences of pre-service teachers they had a good grasp about law regulation and judicial process, understood appointed roles in process. Also critical thinking skills and legal logic thinking skills, problem-solving capability, decision-making in legal issues are developed in mock trial experiences. They told us we can have a look-see on ourselves as to law regulations and promote law-abiding spirit after mock trial experiences. They suggested that selection of scenario subject as to students’ levels is most important. It is effective when subjects are especially relevant to everyday lives or school lives of students. Therefore useful scenario subjects should be developed by law specialist and extended school law-related education class.
