지속가능한 도로를 위한 법제연구— 오스트리아의 이론과 법제도를 중심으로 —

초록
도로는 인간의 필요를 충족시켜주는 중요한 자원이지만 도로이용차량의 연료사용에 의한 온실가스 배출은 환경적으로 심각한 피해를 야기할 수 있다. 지속가능한 도로는 ‘최소한 자신의 필요를 충족시킬 미래세대의 능력을 위태롭게 하지 않으면서 현재의 교통수요를 만족시키는 것’으로 정의할 수 있다. 오늘날의 사회, 경제적 추세는 도로 위 차량의 운행을 증가시키고 있으며 이에 따라 환경적 역기능의 염려도 점차 커지고 있다. 오스트리아 비엔나의 경우 지속가능한 도로를 실현하기 위하여 자동차 이용을 감소시키고 대중교통을 활성화하며 보행과 자전거 이용을 장려하는 정책을 시행하였다. 그 결과 비엔나는 1993년부터 2014년까지의 20여년 동안 일상생활에서의 이동수단 중 자동차의 이용률 3분의 1을 감소시키는 성과를 달성했고 이와 함께 삶의 질적 지표도 상승했다. 비엔나에서의 지속가능한 도로를 위한 정책은 다양한 이해관계자들의 협력을 통해 장기간 통합적으로 계획 및 집행되었으며 국가와 자치단체의 적극적인 재정부담을 통해 효과적으로 실행되었다. 우리나라의 관련법제들 또한 지속가능성의 목표를 달성하기 위한 많은 내용들을 포함하고 있다. 그러나 아직 현실적인 효과를 나타내지 못하고 있다. 우리사회가 진정으로 지속가능한 도로를 목표로 한다면 도로법제의 규범력을 보완하고 실효성 있게 집행할 필요가 있다.
Abstract
Roads are an important resource to meet human needs. However, greenhouse gas emissions from the use of fuel in road vehicles can cause serious environmental damage. Sustainable roads can be defined as 'satisfying current transportation needs without jeopardizing future generations' ability to meet their own needs at least'. Recent economic and social trends tend to increase the need for cars. In Vienna, policies to reduce car use, promote public transport, and encourage walking and cycling are being implemented to realize sustainable roads. As a result, Vienna reduced the car share of trips by a third between 1993 and 2014 from 40% to 27%. Along with this, the quality of life index has risen. The key to success in Vienna was long-term integrated planning and execution through collaboration with various stakeholders. In addition, active financial support from federal and local governments has been a positive impact. Korean legislation also contains a lot of content to achieve goals of sustainability. However, it still has no realistic effect. If we really aim for sustainable roads, road-related laws needs to be complemented and strictly enforced.
