부정경쟁방지법상 트레이드 드레스의기능성원리에 관한 고찰
A Study on the Functional Doctrine of Trade Dress in the Unfair Competition Prevention Act

초록
트레이드 드레스는 상품·포장·영업의 총체적 이미지로 미국 판례를 통해 발전했고, 국내에서는 「상표법」 및 「부정경쟁방지법」으로 보호될 수 있다. 그러나 특허제도로 보호되어야 할 영역인 “기능성”이 포함되어 있다면보호기간 이후 공공영역으로 환원되어야 할 부분을 영속적으로 보호하는 불합리한 결과를 낳는다. 이를 방지하기 위해 기능성이 있다면 보호하지 않는“기능성원리”가 등장하였고 우리 「상표법」도 이를 받아들인 것으로 보인다. 그러나 「부정경쟁방지법」상 기능성원리의 적용이 가능한지에 대해서는 명문의 규정이 없고 관련 논의도 미비한 실정이다. 이에 본 연구에서는 기능성원리가 발전한 미국 판례를 통해 동 원리에 내재되어 있는 “상표제도와 특허제도 충돌방지” 및 “부당한 경쟁제한 방지” 이념을 규명하고, 이는 「부정경쟁방지법」의 이념과 같음을 제시하며 혼동초래행위에 있어서 상표의 경우와 동일한 기능성원리 적용을, 형태모방행위에있어서는 단서(2) 해석에의 적용을, 일반조항에 있어서는 보호한계 설정을위해 적용하는 방안을 제시한다. 또한 「부정경쟁방지법」과 기능성원리의 조화를 위해 부정경쟁행위의 정의규정에 “정당한 이익”을 추가하고, 미등록 트레이드 드레스를 보호하기 위한 부정경쟁행위 유형을 신설하되 동종영업에서 통상적이거나 불가결한 요소만으로 이루어진 경우는 보호하지 않도록 하는 개정안을 제시한다. 이러한 노력을 통해 기능성원리는 우리 「부정경쟁방지법」상 보호한계를 제시하며 트레이드 드레스의 적정한 보호를 가능하게할 것이다.
Abstract
“Trade Dress” involves the total image of a product. It has been developed in the American case laws and can be protected by the Trademark Act and Unfair Competition Prevention Act in Korea. However, if “functionality”, which is the area to be protected by the patent system, is included, it has the unreasonable effect of permanently protecting the portion to be returned to the public domain after the protection period. In order to prevent this, “functional principle” has developed which does not protect trade dress if it is functional. However, there is no definition about the possibility of applying the Functional Doctrine under the Unfair Competition Prevention Act. Therefore, in order to harmonize the Unfair Competition Prevention Act and the functional principle, this study adds “fair profit” to the definition of unfair competition behavior and establish a clause to protect the trade dress, If so, this study proposes an amendment not to protect it. Through these efforts, the functional principle will provide the protection limit for our Unfair Competition Prevention Act and will enable appropriate protection of trade dress.
