국가기준정보 제도 도입을 위한 입법과제

초록
우리나라는 50년 역사의 전자정부 추진을 통해 다량의 행정정보를 축적하였고, 향후 인공지능, 빅데이터 등 지능화된 정부로 나아가기 위해서는 행정정보의 부가가치를 높이기 위한 활용기반 구축이 중요하다. 그러나 이러한 기술환경의 변화에도 불구하고 범국가적으로 공동활용이 필요하고 고도의 정합성 및 통일성이 유지되어야 하는 국가행정의 기반이 되는 정보에 대한 공통 활용 및 관리체계의 구축은 여전히 미흡하다. 국가행정의 기준이 되는 정보에 대한 범국가적 관리가 이루어지지 못하고 보유기관별로 관리가 이루어짐으로서 기관 간 상충되거나 참조에 누락이 발생하고 있다. 이러한 정보에 대한 공동 활용의 편리성은 차치하고서라도, 정보의 최신성·정확성 등 품질관리가 제대로 이루어지지 않고 있다. 이는 결국 정보를 기반으로 하는 지능화된 전자정부에 다발적 행정의 오류를 발생시키며 국민에게는 불편을 초래하게 된다. 본고에서는 「전자정부법」, 「공공데이터법」, 「국가기록물관리법」 등 현행 행정정보 법제가 지니는 한계를 분석하였다. 그리고 이를 극복하기 위해 ‘행정기관등이 생성 또는 취득하여 전자적 방식으로 처리하고 있는 정보 중 범국가적 공동 활용이 필요하고 고도의 정합성이 유지되어야 하는 국가 행정의 기준이 되는 정보’를 ‘국가기준정보’라 칭하고 이에 대한 범국가적 관리·활용체계를 도입하는 입법방안을 제안하였다. ‘국가기준정보’ 정책 추진을 위한 추진체계, 국가기준정보의 지정·활용 프로세스 구체화, 국가기준정보의 관리 및 활용 기반 조성을 위한 구체적 입법방안을 제안하였다.
Abstract
Korea has accumulated a large amount of administrative information through 50 years of e-government promotion. In order to become an intelligent government in the future, it is important to increase the added value of administrative information and establish a foundation for its utilization in the evolution of technological environment such as artificial intelligence and big data. However, despite these technological changes, it is still not enough to establish the utilization and management system of information that is the basis of the national administration, which requires common use across the country and high level of consistency and accuracy. National management of information that is the standard of state administration is not carried out and management is carried out separately for each holding organization, so that there is a conflict between the information held by the institutions or the reference is missing. In addition of the convenience of the utilization of such information, the quality of information such as the latest and correctness of information is not properly managed. This ultimately causes multiple administrative errors in the intelligent e-government based on information, and inconveniences for the public. In this paper, we analyzed the limitations of the current administrative information law such as "e-government law", "public data law" and "national records management law". In order to overcome this, this study proposed that 'the information which is the standard of the national administration which requires the utilization of the national and the high level of consistency among the information that is generated or acquired by the administrative institution and processed electronically' is referred to as 'national standard information', and proposed a plan to improve the legislation to introduce a system of national management and utilization of such information. More specifically, we proposed a specific legislative plan for the implementation of the 'national standard information' policy, the specification of the process of designating and utilizing national standard information and a concrete legislative plan for the establishment of a basis for the management and utilization of national standard information.
