오늘날 제4차 산업혁명이 진행되면서 새로운 법적 문제가 등장하고있다. 이러한 예로서 ‘빅데이터’(big data)와 관련된 문제를 들 수 있다. 빅데이터는 이전에는 가능하지 않았던 새로운 사회적 공리를 제공한다. 그러나 동시에 빅데이터는 우리에게 새로운 위험을 안겨준다. 가장 먼저언급할 만한 것으로서 빅데이터에 의해 우리의 내밀한 개인정보가 심각하게 침해될 수 있다는 것이다. 이외에도 빅데이터는 다양한 사회적 위험을 야기한다. 그러면 이렇게 빅데이터가 야기하는 위험에는 어떻게 대응해야 하는가? 어떻게 하면 빅데이터가 가져다주는 사회적 혜택을 누리면서도 빅데이터가 초래하는 위험을 억제할 수 있을까? 이 글은 ‘빅데이터와 인권’이라는 견지에서 이 문제에 접근한다. 빅데이터는 두 가지 의미를 지닌다. 형식적 의미와 실질적 의미가 그것이다. 형식적인 의미로 볼 때, 빅데이터란 거대한 데이터를 말한다. 실질적인 의미로 볼 때, 빅데이터란 수학적 알고리즘으로 빅데이터를 분석함으로써 과거에는 알지 못했던 새로운 정보나 통찰을 발견하고 이로써미래를 예측할 수 있도록 하는 것을 말한다. 빅데이터는 현대사회의 새로운 성장동력으로서 사회의 다양한 영역에서 활용될 수 있고, 이를 통해다양한 사회적 공리를 창출한다. 빅데이터는 새로운 정보나 통찰을 얻는데 기여한다. 그러나 빅데이터 역시 부정적인 역기능 역시 수행할 수 있다. 말하자면, 빅데이터 그 자체가 새로운 사회적 위험이 될 수 있는 것이다. 빅데이터가 초래하는 위험은 크게 세 가지 단계에서 찾아볼 수 있다. 첫째, 빅데이터를 수집하는 단계에서 빅데이터는 개인정보를 침해할수 있다. 둘째, 빅데이터를 분석하는 과정에서 ‘편향성’이라는 위험이 발생할 수 있다. 셋째, 빅데이터를 이용하는 과정에서 ‘새로운 차별’이라는위험이 발생할 수 있다. 그러면 이렇게 빅데이터가 야기하는 위험에 우리는 어떻게 대응해야하는가? 이러한 위험에 대응하는 방안으로는 크게 권리중심적 대응방안과 의무중심적 대응방안을 고려할 수 있다. 권리중심적 대응방안은 각 개인에게 권리를 부여함으로써 위험에 대처하는 방안을 말한다. 이에 대해의무중심적 대응방안은 개인적ㆍ사회적 위험을 야기할 수 있는 행위주체에게 특정한 의무를 부과함으로써 그 상대방이나 사회 전체를 보호하는대응방안을 말한다. 오늘날에는 이러한 두 가지 방안 중에서 기본적으로권리중심적 대응방안을 선택하는 것이 타당하다. 권리중심적 대응방안 중에서도 인권으로써 빅데이터가 야기하는 위험에 대응하는 방안이 가장바람직한 방안이라고 말할 수 있다. 왜냐하면 인권이야말로 가장 포괄적이면서 보편적인 권리이기 때문이다. 이렇게 빅데이터가 야기하는 위험에대응하는 방안으로 인권을 선택한다면, 빅데이터 위험에 효과적으로 대응할 수 있도록 인권을 구체화할 필요가 있다. 이에 관해 이 글은 기존의‘정보인권’을 보완하는 인권으로서 ‘빅데이터 인권’을 제안한다.
Abstract
Today, as the fourth industrial revolution progresses, new legal problems are emerging. An example of those is the problem associated with ‘Big Data’. Big Data provides new social utilities that were not possible before. At the same time, however, Big Data puts us at new risks. The first thing to mention is that Big Data can seriously infringe our intimate personal information. Big Data also poses a variety of social risks. So how do we deal with the risks of this Big Data? This article approaches this issue from the perspective of ‘Big Data and a new concept of human rights.’ Big Data has two meanings. It is formal and practical. In a formal meaning, Big Data is simply huge data. In a practical meaning, Big Data is the analysis of big data with mathematical algorithms to discover new information or insights that were not known in the past, and thus to predict the future. Big Data can be utilized in diverse areas of society and helps to gain new information and insights. However, Big Data can also perform negative dysfunctions. There are three major stages in the risk of Big Data. First, at the stage of collecting big data, Big Data can infringe personal information. Second, there is a risk of ‘bias’ in analyzing Big Data. Third, there is a risk of ‘new discrimination’ in the process of using Big Data. So how do we respond to the risks of this Big Data? As a countermeasure against those risks, it is possible to consider a rights-based countermeasure and a duty-based countermeasure. The rights-based countermeasure is a measure to cope with risks by granting rights to each individual. The duty-based countermeasure is countermeasure to protect the other party or the society as a whole by imposing certain obligations on the actors who can cause personal and social risks. Nowadays, it is reasonable to choose the rights-based countermeasure from these two methods. Especially, the human rights-based countermeasure is the most desirable method. This is because human rights are the most comprehensive and universal right. If we choose human rights as a way to respond to the risks posed by Big Data, we need to refine human rights so that we can effectively respond to Big Data risks. In this regard, this article proposes ‘human rights against Big Data’ as human rights complementing ‘human rights to information.’
