석탄화력 발전소 관련 법･정책의 개선 과제 - 삼척 석탄화력 발전소 추진 사례를 중심으로 -

초록
우리나라의 석탄화력 발전 비중은 최근 꾸준히 증가해왔으며, 기후변화, 대기오염 등 환경정책 측면에서 여러 가지 우려의 대상이 되고 있다. 이 글에서는 최근의 석탄화력 발전소 추진 사례를 소재로 지속가능한 에너지･환경 법･정책의 방향을 모색해 보고자 하였다. 2001년 발전부문이 경쟁체제로 전환됨에 따라 현재 발전사업 허가 체제는 전력수급기본계획에 반영된 설비들을 대상으로 전기사업법에 따라 발전사업자 허가가 일단 이루어진 후에 환경영향평가가 이루어지고, 주민 의견 청취, 지방자치단체 및 관계 행정기관과 협의, 심의 절차를 거쳐 건설계획을 확정하는 절차를 거치고 있다. 이에 따라 사업자 주도하에 지역경제 활성화에 기여하겠다는 구속력 없는 약속을 내세워 지방의회와 지역주민의 동의를 얻고 발전소의 입지 등 주요 사업계획을 결정하여 발전사업허가를 받고 나면, 후행 절차에서 환경성, 주민수용성 등이 문제되더라도 실질적인 대안에 대한 정보 공유와 논의가 전혀 이루어지지 못하고 있다. 운영 과정에서 실제로 대기질 악화와 건강 피해가 현실화될 경우 지역주민들의 건강권을 보장할 수 있는 조치 역시 부족하다. 그간 우리 정부는 경제성을 우선하는 에너지 법･정책 기조 하에 석탄 발전을 고수해 왔고, 환경 정책 역시 그러한 정책기조를 존중하는 입장을 취해온 것으로 보인다. 그러나, 미세먼지 등 대기오염 문제가 날로 심각해지고, 국가차원에서 강도 높은 온실가스 저감을 국제사회에 약속하는 등 정책 환경의 변화에 따라 기존의 에너지 정책에도 변화가 요구된다. 환경법･정책 역시 화력발전소에 대한 배출시설규제, 배출부과금 제도, 온실가스 배출권거래제 등을 통해 전력생산으로 인한 사회적 비용을 내부화하는 정책을 도입하고 건강영향을 호소하는 주민의 권리를 보호할 수 있는 제도를 갖추어 감으로써 보다 적극적으로 에너지 정책의 변화를 지원하는 역할을 할 수 있을 것이다.
Abstract
The proportion of fossil fuel plant in power plant industry has consistently increased in Korea and it becomes widespread concerns with regard to climate change, air pollution and environmental policy. This paper tries to explore sustainable energy policy and environmental policy of Korea by analyzing a recent controversy in Samcheok over building a coal power. Ever since the electricity industry reform in 2001, private companies are allowed to operate in the electricity market. Under the current Electric Utility Act, environmental and social reviews are carried out as a form of the Environmental Impact Assessment only after the power license to be issued. This makes it hard to come up with alternatives to reduce environmental impacts. Also, there tends to be not many options left to the local residents upon operating the plant. All in all, it seems that Korean government depends heavily on coal under current energy law and policy framework which puts priority on economics. Environmental policy seems to have respected such policy direction. However, the existing energy policy needs to change as the situation surrounding fossil fuel has changed, for example the air pollution problem such as Particulate Matter becomes very serious and internationally the government are required to keep the promises to reduce the GHGs. Environmental laws and policies can also play a key role in encouraging such a change by introducing policies that can internationalize the social and environmental costs of power generation with stronger emission regulation, emission charge system, and greenhouse gas emission trading system and by providing legal grounds for the locals exercise their rights to clean air.
