이 연구는 1970년대의 소설을 통해 법의 무의식 속에서 작동하는 권력과 저항의 변증적 관계를 규명해 내고 이를 통해 사회내에서 법이 작동하는 경로를 포착하는 한편, 법과 사회발전의 새로운 담론축을 구성하고 있는 인권과 연대성에 입각한 “법의 지배”로서의 사회발전을 추동할 수 있는 인문학적 토대를 모색하고자 하였다. 이를 위하여 이 연구는 칼 슈미트, 조르조 아감벤, 자크 랑시에르 등의 논의로부터 “예외상태”론과 “정치적인 것”을 구성하면서, 데리다의 아포리아 개념 및 무페의 급진적 민주주의론을 빌어 작중인물들의 주체화가능성을 천착하였다. 근대화의 과정에서 빈발하는 사회적 갈등을 예외상태의 틀에 따라 구성하고 소설의 작중인물들이 스스로 주체화되면서 ‘정치적인 것’을 구성해 나가는 과정을 분석하고자 한 것이다. 1970년대의 소설은 사회가 지니고 있는 총체적 모순을 제대로 반영해 낸다. 이 연구가 대상으로 삼는 이청준, 조세희, 황석영, 최인호 등의 소설뿐 아니라, 송기원, 오정희, 이문구, 이문열, 김정한 등의 소설은 당대의 시대적 모순에 가장 민감하게 대응하고 있다. 일상적 삶의 현실이 근대화와 산업화, 그리고 냉전의 정치구조 속으로 포섭되는 양상들이 잘 드러나고 있을 뿐 아니라 그 포섭의 과정에서 발생하는 국가폭력과 법폭력, 그리고 그에 대한 작중인물들의 다양한 대응양상들이 폭넓게 그려지고 있다. 다양한 서사를 통해 국가법에 대한 다양한 시선들을 투사하고 이로부터 법의 다양한 실체들을 드러내고 있는 것이다. 이 연구는 이런 법의 무의식을 드러냄으로써 새로운 정치 - 혹은 정치적인 것-를 재구성할 수 있는 가능성을 분석하고 법권력에 대한 작중인물의 태도(피동적/능동적)와 대응양식(환속화/세속화)에 따라 유형화하였다. 법권력에 대한 금기회귀의 양상은 환속화에 대응되는 것으로 황석영, 김정한, 조세희 등에서 나타나며 스스로 법주체가 되어 국가법을 잉여화하는 한편 법의 경계를 초월하는 세속화의 과정은 오정희, 윤흥길, 조해일 등에서 읽어낼 수 있었다. 이 글은 이런 관점에서 차이와 다양성에 기반하는 법텍스트의 창조적 해석을 제창한다. 법은 법텍스트의 독해를 통해 그 의미가 확정된다. 그러나 이러한 법텍스트의 독해가 일의적이고 일방적으로 진행될 때에는 그 자체 권력 내지는 폭력으로 변질되어 버리고 만다는 사실은 1970년대의 소설들에서 극명하게 드러난다. 법이 소통의 계기로 작동하는 것이 아니라 억압과 질곡의 수단으로 동원될 때, 민중들은 무조건적으로 그에 복종하지 않고 오히려 다른 법적 수단을 강구하거나 스스로 입법자로 변형하거나 혹은 법 그 자체를 잉여로 전이시킴으로써 그 권력을 우회하고 또 회피한다. 이 연구는 “역사적 결정체로서의 법에 대한 의도적인 오독(誤讀)의 필요성을 강조”함으로써 1970년대가 안고 있었던 저항의 가능성을 제시해 보았다. 당대의 민중들이 보였던 저항과 그로 인한 법현실의 변혁가능성을 그 소설들에서 재구성해 본 것이다. 그리고 이를 바탕으로 새로운 공동체의 질서를 형성함에 기여해야 하는 법의 사명을 새로이 구성해 냄으로써 법이 진정으로 인권과 삶의 가치에 봉사할 수 있는 틀을 모색할 수 있는 기회를 창출해 낼 수 있었다.
Abstract
This study reads the novels of the 1970s to examine the dialectical relationship between repressive power of the dominant groups and resistance of the ordinary people through analysing the unconsciousness of law, which had been perceived and received as basis of people-made laws. Through such reading, this study aims to explore the humanistic basis for promoting social development as the “rule of law” based on the human rights and solidarity. For these purpose, this study constructs analytic framework of “the exceptional state" and ”the political“ from the arguments of C. Schmitt, G. Agamben, and J. Rancière to find out the possibility of subjectification of the characters in the novels, in which this study forcuses on Derrida's concept of aporia and the radical democratic theory of C. Mouffe. Novels in the 1970s reflects the total contradiction of the society of that era. Novels of such as Song Ki Won, Oh Jeong-hee, Lee Moon-gu, Lee Mun-yul and Kim Jung-han are the most sensitive to contemporary contradictions, as well as those of Lee Chung Joon, Jo Se-hee, Hwang Seok-young, and Choi In-ho. Those novels reveals not only the aspects of everyday life embedded in the political structure of modernization, industrialization, and the Cold War, but also the various forms of coping with violence of law and state. They project diverse perspectives on national law through various narratives and reveal various realities of legal system. This study analyzed the possibility of reconstructing a new politics by revealing the unconsciousness of this law, and typified it according to the attitude and the response style of the characters in the law power. This study suggests a creative reading of legal text based on diversity and diversity in this respect. The substance of law is determined by reading the text of the law. However, the fact that the reading of these legal texts is transformed into power or violence itself when it is unilateral and unilateral, is clearly revealed in novels of the 1970s. When the law is mobilized as means of oppression and vengeance, the people refuse to obey it unconditionally, but instead bypass and avoid it and take other legal means, transform themselves into legislators, or transfer the law itself to surplus. This fact is evident in the novels of the 1970s, which show poeple’s potential powers of the resistance to law’s oppression and transforming the legal reality.
