미국 뉴욕주의 재생에너지 법제에 대한 연구

태양광, 바람, 물과 같이 자연계에 상시 존재하는 에너지 흐름으로부터 만들어지면서 신속하게 재생되어, 석탄, 석유 같은 화석연료처럼 전세계적인 기후변화를 촉발하는 온실가스 같은 오염원을 배출하지 않는 재생에너지는 기후변화로 몸살을 앓고 있는 세계 모든 국가들이 총력을 기울여 개발하고 있는 새로운 대체에너지의 선두주자다. 트럼프 행정부가 2015년 파리기후변화협정에 대한 미국의 약속을 이행하지 않겠다고 공언한 이후에도, 미국 기후변화 대응을 주도하고 있는 미국 뉴욕주는 재생에너지 중심의 청정에너지와 청정 일자리 경제를 지향하면서 청정 에너지 경제(clean energy economy)로의 도약을 위해 총력을 기울이고 있다. 2016년 이후 뉴욕주 하원에서 계속 입법화된 ‘뉴욕주 기후 지역사회 보호법(New York State Climate and Community Protection Act)’은 재생에너지 중심의 청정일자리, 청정에너지 경제를 추진함에 있어서 이러한 경제 패러다임의 변화에 제대로 대응하지 못하는 저소득층과 취약 계층을 위해 환경적 정의와 형평성의 원칙을 고려한 재생에너지 혜택의 분배적 정의 원칙을 법 원칙으로 규정하고 있다. 이런 원칙은 2018년 쿠오모 뉴욕주지사가 발표한 ‘청정에너지 일자리와 기후변화 아젠다(Clean Energy Jobs and Climate Agenda)’를 비롯한 뉴욕주정부의 핵심 재생에너지 정책들의 추동원리가 되면서, 뉴욕주의 재생에너지 정책을 단순한 양적 발전 중심의 에너지 경제에서 청정일자리 청정에너지 경제로의 질적인 도약을 추구하는 원리가 되고 있다. 뉴욕주의 청정에너지 경제로의 변환이라는 질적인 도약은, 기후변화에 대한 대응을 위해 온실가스 감축을 위한 대체에너지원의 최대 확대라는 측면에 주력하고 있는 한국의 재생에너지 법제에 환경정의(environmental justice), 환경 형평(environmental equity) 측면에서 시사점을 제공하고 있다.
Abstract
Renewable energy such as solar, wind and water is produced and reproduced rapidly, from the energy flow constantly existing in nature, without emitting greenhouse gases to cause the worldwide climate change, such as fossil fuels of coal and gas. So, renewable energy sources are leaders of new alternative energy that all countries in the world are exerting their best efforts, in the midst of radical climate change phenomena. Even after the Trump administration announced that the US would not keep its pledge submitted to the Paris Conference of Parties of the United Nations Framework Convention on Climate Change, the State of New York has been one of the leader states to fight against the climate change and has exerted its best efforts toward clean energy economy focused on clean energy and clean jobs based on renewable energy. New York State Climate and Community Protection Act of 2016 is a new law passed in the New York State Assembly for the last three years. The law shows that the legal principle of distributive justice of renewable energy benefits should be considered along with the environmental justice and equity, for low income class and vulnerable community in the change process of economic paradigm toward clean jobs and clean energy economy based on renewable energy. Such principles also have embedded in the core renewable energy policies of New York State, including 'Clean Energy Jobs and Climate Agenda' announced by Governor Cuomo in early 2018, whereby the State of New York has been pursuing qualitative transformation to clean jobs and energy economy from simple quantitative energy economy. Such qualitative transformation to clean energy economy of New York State provides environmental justice and equity implications to the Korean renewable energy law and policies since the Korean renewable energy policies are mainly focused on quantitative expansion of alternative energy sources to meet the reduction standard of greenhouse gases emission against responding to the climate change.
