초록
본 연구에서는 GDPR에 대한 우리 법제의 현실적이고 실질적인 대응책을 마련하기 위해 적정성평가를 먼저 통과한 일본법제의 시사점을 파악함으로써 우리 개인정보보호법제의 나아가야 할 방향을 가늠해 보는 것이 주된 목표이다. 이를 위해 제2장에서는 GDPR에 대해 전반적으로 개관해보고, 제3장에서는 GDPR에 대비한 일본의 개인정보보호 법제에 대해서 분석해보며, 제4장에서는 본 연구의 핵심적인 내용으로서 일본법제의 함의와 우리나라 개인정보보호법제의 개선방향에 대해서 제시했다. 이처럼 본 연구는 우리에게 많은 영향을 주고 있고 앞으로 그 비중이 증대될 것이 분명한 GDPR에 대해 살펴보고 대응하기 위한 방향설정에 초점을 맞춰 진행하였다. 특히 앞서 여러 번 언급한 것처럼, 우리보다 먼저 EU의 적정성 평가를 통과한 일본은 우리와 다른 어떤 노력을 기울였는지 확인하기 위해 일본의 개인정보보호 법제의 특징, 체계, GDPR 대응 현황 등에서 나타나는 주요 사항을 확인했다. 이 모든 결과물은 현재 국회에 계류 중인 개인정보보호 법제 개정안에 대한 논의를 진행하는 과정에서 반드시 포함되어야 할 사항을 미리 예측할 수 있고, 이는 곧 현실적이고 실질적인 GDPR 대응방안임을 의미한다고 볼 수 있다.
Abstract
In this study, we confirm the implications of Japan that passed the adequacy evaluation in order to establish an effective countermeasure for our legislation on GDPR. The primary goal is to anticipate the improvement of Korean legislation. In Chapter 2, we overview the GDPR in general. In Chapter 3, we analyze the Japanese personal information protection legislation in preparation for GDPR. And In Chapter 4, We suggest ways to improve the personal information protection legislation. Thus, this study focuses on setting direction to look at and responds to GDPR, which has a great impact on us. As I mentioned several times in the past, Japan which passed the EU adequacy evaluation before us, confirms what other efforts we have made. To this end, I have summarized the main features of the characteristics of the personal information protection legislation in Japan, the system, and the status of GDPR response. All of this can be seen in advance in the process of discussing the amendments to the personal information protection legislation currently pending in the National Assembly. This means that it is a real GDPR countermeasure.
