헌법상 평생교육의 개념 정의

Regarding the Lifelong Education, the Article 31 (5), (6) of the Constitution uses the term. Especially the above (6) uses the School education and Lifelong Education in parallel order, and the Article 2 (1) of the ‘LIFELONG EDUCATION ACT’ defines the “lifelong education” not including the regular school education, that makes the concept of Lifelong Education recognized in the concept of excluding the regular school education. But, the term written in the Constitution has the openness by the change of socialㆍjurisprudential aspects. And the concept of Lifelong Education developed by the field of pedagogy is nowadays regarded as including the regular school education, in the modern society with the change from the academic background-oriented society to the abilityㆍinformation-oriented society various form of education is being performed. In the form of the existing education-related law, the mixtureㆍconvergence between the regular school education and the Lifelong Education in the narrower sense is being observed such as ‘School-Style Lifelong Educational Establishments’. With these all considerations, the concept of the Lifelong Education should be perceived as including the regular school education. Futhermore, if the education is understood in the big frame of the Lifelong Education, ‘the right to receive an education’ would be regarded as the fundamental right in the field of not only the regular school education, but also the whole Lifelong Education, and in the aspect of the education being means to the other fundamental right or acquiring certain status as a member of a society, it would hold the practical meaning of enhancing the status of ‘the right to receive an education’.
