공무원의 복지증진을 위한 법･제도적 고찰- 소방공무원을 중심으로 -

소방공무원은 업무의 특성으로 인하여 위험에 대하여 장기, 반복적으로 노출되어 있는 상황에서도 국민의 생명과 신체를 안전하게 보호하기 위하여 임무를 수행하고 있다. 그러나 유독가스의 노출, 충격적인 사건, 사고의 현장에서 발생하는 스트레스나 업무과중으로 인한 자살과 현장활동 중 발생하는 공,사상자에 대한 복지 및 근무여건의 처우 등은 열악한 실정이다. 이를 위해 소방공무원 보건안전과 복지를 위한 법률인 「소방공무원 보건안전 및 복지 기본법」 이 제정되었으며 2012년 8월 23일 시행되었다. 하지만 법 시행 이후에도 소방공무원의 복지처우가 크게 개선되지 않은 문제점들이 나타나게 되었고 이를 해결하기 위해서는 법, 제도적인 고찰을 통하여 지속적인 관심과 더불어 연구도 되어야 할 것으로 생각된다. 따라서 본 논문에서는 소방공무원의 복지에 대한 「소방공무원 보건안전 및 복지 기본법」의 입법적 배경과 법적 근거를 살펴보고, 현재 소방공무원의 현황과 순직 및 공·사상자의 현황을 파악하였으며 소방공무원의 복지증진을 위하여 「소방공무원 보건안전 및 복지 기본법」에 있어서의 법제 정비방안을 모색하였다. 또한 위험하고 열악한 근무환경에서 의료지원의 확대와 현장출동 등에 따른 정신적 트라우마 피해에 대한 구제를 위한 의무적인 정신 건강 프로그램의 도입 및 소방공무원의 불법행위 책임에 대한 변호인의 조력을 받을 수 있도록 소방공무원의 직무와 관련된 전담변호인의 도입 등을 제시하였다. 소방공무원의 복지증진을 위하여 관련된 다양한 제도를 연구하여 법･제도적 개선방안을 제시함으로서 그동안 열악한 근무환경 속에서도 국가와 국민의 생명과 신체 및 재산을 안전하게 보호하기 위해 희생하고 봉사한 소방공무원들에게 큰 힘이 될 것으로 사료된다.
Abstract
Fire fighters perform their mission to ensure the safety of the lives and bodies of people, though they continue to be exposed to dangers on a long-term basis due to their job characteristics. They are exposed to toxic gas, and some commit suicide because of stress from shocking incidents or accidents or of heavy workload, Furthermore, there are lots of casualties. However, their welfare, working conditions and treatment are all poor. To remedy the situation, a fundamental law on the health, safety and welfare of fire fighters was enacted, which is a law to guarantee the health, safety and welfare of fire fighters, and that has been enforced since August 23, 2012. But there are still continuing problems because there isn't any significant improvement in their welfare and treatment even after the law started to be enforced. To change this situation, legal and institutional consideration, continuing attention and prolonged research efforts are all required. In this study, the legislative background and legal grounds of the fundamental law on the health, safety and welfare of fire fighters were investigated. The state of fire fighters and the state of casualties including those who died on the job were analyzed, and how to improve this law was explored. And then the extension of medical assistance was suggested to improve the hazardous and harsh working environments, and it's also suggested that mandatory mental health programs should be introduced to relieve the damage of mental trauma resulting from being on the scene, and that a counsel system related to the duties of fire fighters should be introduced to help them receive professional help from counsels about their liability for an illegal action if there's any. The effort by this study to research various systems related to fire fighters to suggest how to improve the law and system to promote their welfare is expected to give a great strength for them who serve and sacrifice themselves for the nation and for the protection of the lives, bodies and properties of people in spite of tough working environments to go on.
