재난 후 ‘지원’에 대한 법⋅제도적 분석

초록
재난은 인간에 막대한 피해를 입히므로 사전에 억제하고 예방하는 것이 최상이지만 모든 재난을 발 생 이전에 막는 것은 현실적으로 불가능하다. 그렇게 본다면 재난이 일어난 후 그 피해를 최소화하고 원래의 상황으로 회복할 수 있도록 피해자들을 ‘지원’하는 일도 매우 중요함에도 이는 제대로 이루어 지지 않았다. 이 글은 재난 후 ‘지원’의 현황과 문제점을 법⋅제도적 차원에서 고찰하고 대안을 제시 하기 위해 작성되었다. 이를 위해 재난 후 ‘지원’을 재난관리 단계 중 ‘복구’ 단계와 ‘대응 단계 중 인 명구조 등 일부’를 포함하는 것으로 개념화한 후, 이것이 범죄피해자구조청구권과 논리구조가 유사함 에 착안하여 재난 후 ‘지원’을 시혜가 아닌 권리로 볼 수 있음을 논증하였다. 그리고 관련 법제인 ‘재 난 및 안전관리 기본법’, ‘자연재해대책법’, ‘재해구호법’에 규정된 지원에 대한 내용을 분석하고 그 문제점들을 각각 살펴보았다. 이를 통해 재난 피해자들은 필요한 지원을 받을 권리를 갖으며 국가는 이들을 지원할 책무를 갖고 있음을 인식해야 하고, 지원의 핵심에 ‘사람’을 두어야 함을 강조하였다.
Abstract
Disasters cause enormous damage to humans, so it is best to control and prevent them in advance. But it is practically impossible to prevent all disasters before they occur. In that sense, it is very important to minimize the damage after the disaster and to help victims recover to the original situation. Nevertheless it was not done properly. This article was written to consider the current situation and problems of ‘assistance’ after the disaster and to suggest alternatives on the legal and institutional perspective. To this end, I conceptualize ‘assistnace’ after disasters as ‘recovery’ and ‘part of saving a life during response’ on disaster management stage, argue that it could be regarded as a right, not a benefit. And I analyze the details of assistance provided by the relevant laws, i.e. ‘Framework Act on Disaster Control and Safety Management’, ‘Act on Countermeasures Against Natural Disasters’, and ‘Disaster Relief Act’, and look at the problems. In doing so, it emphasize that disaster victims should have the right to receive the necessary assistance, that the state has a duty to support them, and that “humanity” should be at the core of their assistence.
