생체인식정보의 활용과 개인정보보호에 관한 비교법적 고찰 ― 미국의 법제를 중심으로 ―

Biometric information has recently been used in a variety of areas, and most of all, it is the only and unique sign that a particular individual can have, and it cannot be copied or replaced. Despite these advantages, biometric technology creates ethical or privacy concerns in that it uses human biometric or behavioral analysis to achieve security goals. In particular, biometrics that utilize information systems pose privacy infringement problems, and the use of biometric information as big data can provide insight into personal tastes, favors, and tracks, which can lead to serious loopholes in privacy protection. Furthermore, registered passwords, which are generally used in individual security identification process, can be easily changed as needed, whereas biometrics information is unique and immutable That is why the leak of biometrics information poses serious problems on the protection of privacy and personal data. Therefore, this article introduces various research results on how to collect and promote biometric information due to characteristics that cannot be easily changed. This paper intends to ultimately get the implications on our legal soil by conducting comparative research on biological information utilization and regulation, such as research, case, legislative precedent and normative assessment.
