미국 연방 독립규제위원회 행정입법에 대한 입법평가 의무화 논의에 관한 연구

In the United States, the legislative review system has been focused on the specific regulatory areas including the environment, health or disaster management etc. However, after 2017 President's Executive Order, new legislative approaches has been appeared including Regulatory Accountability Act, the OIRA Insight, Reform, and Accountability Act or more bills, which mandate the legislative reivew system. Especially as current discussions mainly focused on the regulatory reform or control on the administrative rules, main legal issues are (i) what the subject of the review system and (ii) how to set the specific or clear standards in the legislative review process. In Korea, legislative review system has been discussed with regards to each laws or local ordinances while administrative regulations had not been mainly included. However, as more administrative regulations appear and become more significant, they might be reviewed under the legislative review system. Since the review system has been developed for more than ten years in Korea, it needs to be more specific including the determinants, standards, or approaches to use the review results.
