인도의 유전자원 및 관련 전통지식에 대한 접근 및 이익 공유(ABS) 절차 및 사례 연구

유전자원 제공국의 입장을 주도하는 인도는 유전자원 접근 및 이익 공유(ABS)에 관한 입법적, 행정적, 정책적 조치를 세계에서 가장 많이 채택한 국가이다. 뿐만 아니라 인도는 지금까지 유전자원 및 관련 전통지식에 대한 ABS 사례를 ABS-CH에 가장 많이 공개한 국가이기도 하다. 나고야의정서가 발효 된지 4년이 지난 지금, 나고야의정서가 제대로 이행되고 있는지에 대하여 많은 관심이 집중되고 있다. 우리나라도 2018년 8월 18일부터 「유전자원의 접근·이용 및 이익 공유에 관한 법률」의 시행으로 인해 국내 산업계와 관련 부처의 ABS 사례에 대한 관심과 우려가 동시에 증가하고 있다. 이러한 상황에서, 인도의 ABS 사례를 살펴보면, 인도에는 비상업적 연구 목적 보다는 상업적 이용 목적의 ABS 사례가 더 많고, 유전자원에 대한 ABS 사례가 유전자원 관련 전통지식에 대한 ABS 사례보다 절대적으로 많다. 따라서 본고에서는 인도의 ABS 절차 및 사례를 살펴보고, 인도의 경험을 토대로 우리나라에 시사점을 제공하고자 하다.
Abstract
India which leads genetic resources providers’ stance is the country that has adopted the most ABS legal, administrative and policy measures in the world. And India is also the country that has published ABS cases through ABS-CH. Now that Nagoya Protocol has been in force four years, there is a growing interest in the implementation of the Nagoya Protocol. Concerns and interests about the actual cases of ABS in domestic industry and related ministries are increasing at the same time since 「The Act on Access and Utilization of Genetic Resources and Sharing of Benefits」 came into effect on August 18, 2018. Under these circumstances, looking at the ABS cases of India, India has more ABS cases for commercial use than non-commercial research purposes. And India has much more ABS cases for genetic resources use than associated traditional knowledges. Therefore, this article reviews the Nagoya Protocol implementation trends through ABS procedures and cases in India and presents some implications and lessons to domestic industry and related ministries based on India’s experience.
