조선개국기 삼봉의 법치사상 분석

초록
조선개국 시기 삼봉은 국가의 규모와 운영방식을 중국 고대의 다양한 시각을 조화롭게 엮어 조선시대의 근본 국가통치철학인 『朝鮮經國典』을 私撰하고, 후일 『經國大典』의 모체가 됨과 동시에 국가론 차원의 통치내용과 방법 등을 제시하였다. 특히 현재까지 단편적으로 알려졌던 조선개국기 삼봉 정도전의 통치제도의 형성과정과 주요 내용을 삼봉의 『朝鮮經國典』, 『經濟文鑑』, 『經濟文鑑別集』 등을 중심으로 분석하고 현대의 법치제도적 시사점을 찾고자 시도했다. 그는 주자학을 받아들인 유학자이며, 경세가로 유교 경전에서 제시하는 유교적 이상 국가를 당시 현실에 반영하여 조선을 건국하는데 일생을 바친 인물이다. 삼봉 정도전의 조선개국 사상의 근원은 『書經』과 『周禮』의 민유방본(民惟邦本)에서 유래하였으며, 삼봉은 백성, 국가, 군주의 순으로 그 중요성을 자리매김한다. 그의 사상의 맹아에는 백성을 가장 중시한 民本思想이 깃들어 있다. 이러한 사상적 토대인 민본사상과 윤리 도덕성의 내용은 백성을 주로 하고, 임금과 재상에 대한 대간의 견제를 통한 균형의 유지를 중시한 것으로, 이와 같은 그의 견해는 오늘날 난국을 돌파하기 위한 개헌논의의 이론적 전거의 기반으로 삼을 수 있다.
Abstract
The article is organized as follows. The first clarifies research questions, the purpose of study and methodology about legal thoughts of Sambong in Chosun dynasty. The second deals with methods of study, literature review, previous research and theoretical background of research on legal thoughts of Sambong in Chosun dynasty. The analytical variables of a characteristic of legal thoughts of Sambong in Chosun dynasty are people, bureaucracy & monarch, so forth. The third presents analysis variables about those variables. The forth suggests research effect & limitations for fostering legal thoughts of Sambong in Chosun dynasty. For example, Those are Sambong’s legal thoughts, Kwajon Law(Gua Jun Baeb), Popeum & Sambong's bureaucratic behavior in the early era of the Chosun dynasty. The last section concluded & suggested research effect & limitations of effect analysis of their bureaucratic behavior in the early era of the Chosun dynasty. There were some suggestion & expectation effect of the study.
