The German Land Transactions Act, which prevents speculation on agricultural land and improves the agricultural structure, is being re-evaluated today. The reason is that this law can prevent the risks associated with the agricultural structure of the land market, bring about the development of the international community through the activation of trade between countries, and meet the needs of national economic factors in Germany. And the law originally pursues the formation of national policy goals and stipulates the promotion of 'family farms' as a model for improving the agricultural structure. so it is essential to implement a concrete plan. It is uncertain whether family farms, which are particularly valued as ideal business types, make a particular contribution to sustainable development in terms of social, ecological and economic function. If the protection of family farms is considered meaningful because of their social and economic sustainability, we should look at whether it can be based on constitution or EU law. As a result, family farms are worth supporting for sustainability, so it is necessary to provide normative definitions on the basis of constitution and EU law.
