「노인복지법」상 노인학대 신고제도와 그 개정안

As elder abuse gets severe, the government newly established the rules regarding elder abuse through the reform of the Welfare of the Aged Act in January 29th, 2004, and at the same time, in the purpose of revitalizing reports of elder abuse, it introduced the settlement of the person bound in duty to report elder abuse and the rules of abuse report procedures(Article 39 of the 6). It is true that finding out cases was difficult because a victim of elderly was unwilling to let the problem among the family outside since most of the cases occur in the family. Furthermore, elder abuse tends to continue due to the fact that the elder depend on their children since they have a hard time physically and economically because of the aging and many cases which victims of elderly hide the fact that they are abused to protect their children as being their parents. Therefore, there are many cases of elder abuse with the severe degree and the serious extent of damages of the abuse. Thus, it is needed to forge a system to spot quickly elder abuse through the rationalization of the system of the report of elder abuse in the purpose of efficiently preventing elder abuse and of protecting the elder. So, in this paper, I examined reporting systems of elder abuse in 「Welfare of Older Persons Act : WOPA」. And I suggested the extension of reporting reason, and described their improvement measures to secure the ease of the detection and reporting of abuse. Also, in addition, I proposed amendments to WOPA provisions to actualize them.
