민자도로 관리 감독체계에 관한 비교법적 연구 - 일본의 민자도로 관리 감독체계와의 비교를 중심으로 -

초록
한국에서 유료도로는 민자도로로 정비되고 있다. 그러나 민자도로는 한국도로공 사가 관리하는 도로보다 통행료가 높고, 그에 반해 안전관리와 서비스질이 미치지 못하는 문제점이 꾸준히 제기되고 있다. 이와 같은 문제점을 해결하기 위해 논문 필 자는 일본의 민자도로 관리･감독체계와 비교하고자 한다. 한국의 민자도로 관리･감독체계는 유료도로법과 민간투자법을 기본으로 하고 있 다. 유료도로법은 2018년 1월 17일의 개정을 통하여 민자도로사업의 실시협약 변경 요구권, 민자도로 관리지원센터 조항을 신설하였다. 민간투자법은 공익적 사유로 주 무관청이 일방적으로 사업을 취소할 수 있는 공익을 위한 처분을 규정하고 있다. 일본은 도로정비특별조치법과 PFI법을 골자로 하고 있다. 도로정비특별조치법은 국토교통대신이 권한을 행사할 때 고속도로회사 등으로부터 의견을 청취하여야 하 는 의견 청취 조항을 가지고 있다. PFI법에서는 건설을 동반하지 않는 공공시설 등 운영권 제도를 규정하고 있는 것이 특징이다. 일본의 민자도로 관리･감독법제가 한국에 주는 시사점으로는 1) 건설을 동반하지 않는 민자도로 사업 방식의 활용과 2) 주무관청이 권한을 행사할 때 사업 주체의 의 견 청취를 의무화하여 주무관청과 사업 주체 간의 수평적 관계를 구축하려는 점을 들 수 있다.
Abstract
In Korea, toll road is managed by Private Finance Initiative Road system. But Private Finance Initiative Road has problems. The major problem is unbalance between Private Finance Initiative road fee and quality of road service, compared with toll road which is managed by Korea Expressway Corporation. The writer seeks it’s solution through the comparative study between Korea and Japan. For management and supervision system of Private Finance Initiative road in Korea, we have “Act of Toll Road” and “Act of Private Finance Initiative”. Act of Toll Road was revised in 17, January, 2018. This revised act includes “right to demand revision of Private Finance Initiative contract” and foundation of “Private Finance Initiative Road Management Support Center”. “Act of Priva te Finance Initiative” has established “Right of Termination of Private Finance Initiative contract for public interest”. Public sector can terminate Private Finance Initiative contract for public interest. For management and supervision system of Private Finance Initiative road in Japan, they have “Act on Special Measures concerning Road Construction and Improvement” and “Act of PFI”. “Act on Special Measures concerning Road Construction and Improvement” has Hearing Clause (to Nippon Expressway Corporation and local Expressway Corporation). “Act of PFI” has adopted “PFI Scheme in which private sector performs public facility’s operating work” except construction stage. Management and supervision system of Private Finance Initiative road in Japan can be summerized in two way. First, “PFI Scheme in Which private sector performs public facility’s operating work” except construction stage are adopted. Second, public sector has horizontal relation between government and business operator(e.g. Nippon Expressway Corporation and local Expressway Corporation) through hearing.
