해운환경 변화에 대응한 한국의 해상운송 관련법제의정비 필요성

조선업과 해운산업의 성장에 반드시 필요한 선박금융이 투자자들로부터 그다지 주목을 끌지 못하는 이유는 우선 투자자금회수의 곤란성이나 선박가격의 변동리스크가 높기때문이라고 할 수 있다. 하지만 현재 선박금융이 원활하지 못한 가장 큰 원인은 바로해운산업의 침체에 있다고 본다. 따라서 본고는 직접적인 선박금융의 활성화방안의 모색을 위해서도 이와 불가분의 관계에 있는 해운산업의 지속적 발전이 중요하며, 이와 관련된 계기마련을 위한 해상운송 관련법제 등의 정비가 필요하다는 인식을 바탕으로 하고 있다. 더구나 제4차 산업혁명으로 표현되는 시대를 선도하고 있는 각종 기술의 혁명적 변화로 인하여 새로운 패러다임의 대응이 요구되고 있고 첨단기술을 반영한 새로운형태의 선박이 필요한 시대상황의 변화를 반영한 제도의 정비는 반드시 필요하다고 본다. 시대의 변화에 따라 산업 환경이 변하는 상황에서 종전과 같은 규제나 방임의 태도는 바람직하지 아니하다. 적극적으로 대응할 수 있도록 하는 제도정비를 통해 국가와 기업이 새로운 형태의 협력관계를 구축할 수 있어야 국제경쟁력이 있는 해운기업이 탄생하고 유지될 수 있다. 따라서 선박 및 해상운송에 관련된 법제를 최근에 정비하고 적극적으로 지원하고 있는 일본의 대응사례를 중심으로 그러한 제도정비가 이루어진 배경, 경위, 현황을 살펴보고 우리에게 주는 시사점을 생각해본다. 국제시장의 경쟁에서 한국의 해상기업들이 대등한 경쟁조건을 확보할 수 있도록 하는 것이 국가의 책무이기도 하다. 정부와 사업자의 역할분담으로 새로운 협력관계를 구축할 필요가 있으며, 필요한 자원을 수입하고 수많은 제품을 수출하는 국가로서 해운이 매우 중요한 역할을 담당하여온 만큼, 해운에 의해 국가경제가 지탱되고 있다는 인식을 바탕으로 한국의 해상기업이지속적이고 안정적으로 발전해 나아가도록 하기 위한 국가차원의 전략적인 발상이 필요한 시점이다.
Abstract
The reason why ship financing, which is essential for the growth of shipbuilding and shipping industry, is worse than other investment targets from investors is because of the difficulty of recovering investment funds and the risk of vessel price fluctuation. However, the fundamental reason for the lack of ship financing is the downturn in the shipping industry. Therefore, this paper is based on the recognition that the sustainable development of the marine industry, which is inseparable for the activation of ship financing, is important and that the related maritime transport laws are needed to be maintained. Moreover, the revolutionary change of various technologies leading to the age expressed in the Fourth Industrial Revolution calls for a new paradigm response, and it is essential to establish a system that reflects the changes in the times when new types of vessels are required to reflect advanced technologies. In a situation where the industrial environment changes according to the changes of the times, the attitude of regulating and neglecting as before is not desirable. The government and enterprises need to be able to establish new forms of cooperation through institutional arrangements that enable them to respond positively so that a shipping company with international competitiveness can be created and maintained. Therefore, we will look at the background, situation, and situation of such system improvement centering on Japan's countermeasures, which have been recently restructured and actively supporting legal systems related to shipping and marine transportation, and consider implications for us. It is also the responsibility of the state to ensure that Korean shipping companies have equal competition conditions in the international market. It is necessary to establish a new partnership with the role of the government and the business operators, and it is important to recognize that the marine transportation is supporting the national economy as it has played a very important role in importing necessary resources and exporting numerous products. It is time to develop a strategic idea at the national level to steadily develop Korea's shipping industry.
