북한의 헌법 개정과 권력구조 변화

본 연구는 북한의 김정은 체제를 규정하는 2016년 개정 헌법의 권력구조를 북한의 역대 권력구조 변천의 맥락에서 분석하는 것을 목적으로 한다. 이를 위해 사회주의 헌법의 일반적 성격과 특징을 살펴보고, 북한의역대 헌법 개정에서 이루어진 권력구조 변천을 헌법 조문 분석을 통해 정리한 후, 국무위원장을 새롭게 규정한 2016년 개정 헌법의 의미를 분석했다. 분석결과, 권력구조의 변경을 중심으로 하는 북한의 역대 헌법 개정은 ‘이미 달성하였고 전취한 것을 입법적으로 고정화’하는 경향을 유지하는 가운데, 1972년 개정한 사회주의헌법의 권한집중적 주석제 이후 1992년과 1998년의 헌법개정을 거치면서 점차 권한분산적 방향으로 나아가던 흐름과는 달리, 2009년, 2012년, 2016년 개정 헌법은 권한집중적 방향으로회귀하였음을 알 수 있었다. 이는 김정일에서 김정은으로 이양된 권력이구축되고 공고화되는 과정에서 나타난 변화라고 할 수 있으며, 북한에서내부적인 갈등에도 불구하고 김정은이 당, 군, 정을 모두 장악하는 김정은일인체제가 제도적으로는 이미 구축되었음을 보여주는 것으로 이해할 수있다.
Abstract
The purpose of this study is to analyze the recently revised North Korean constitutional power structure of the 2016 Constitution in the context of the changes of power structure. For this, we organize the general characteristics of the socialist constitution, analyze the transition of the power structure in the previous North Korean Constitutions as a method of text analyzing, and examine the implications of the revised constitution in 2016. As a result of the analysis, the revisions of the previous Constitutions of North Korea have maintained the tendency of the socialist constitution to ‘achieve already and legally fix what they have already done.’ In contrast to the 1972 and 1992 revisions, which proceeded gradually in the direction of decentralization, the amended constitution of 2009, 2012 and 2016 returned to the power-intensive direction. This means that the Kim Jong Un’s System, which takes over the party, the military, and the government, is being built.
