외국인근로자 출국만기보험금의 권리보호방안

최근 우리나라에서 외국인근로자들 사이에 가장 관심이 집중되고 있는 사안이 출국만기보험금의 지급시기에 관한 것이다. 우선 현행법상 고용허가제 하에 외국인근로자나 그 사업주는 네 가지 보험을 의무적으로 들어야 한다. 그 보험들은 상해, 보증, 귀국비용, 출국만기이다. 이를 업계에서는 외국인근로자 전형적 보험으로 본다. 본 연구논문에서는 출국만기보험금에 대하여 논하고자 한다. 현재 관련 법률에 의하면 출국만기보험제도는 대상 외국인근로자가 출국 후에 14일 이내에 그 보험금을 지급하게끔 하고, 이를 통하여 미등록 혹은 불법체류 외국인을 국내에 체류하지 못하도록 하고자 하는 이주노동 정책적 목적을 구현하기 위해 퇴직금 지급과 의도적 출국이라는 관계를 강제하는 것이 합리적이고 정당한지 문제가 된다. 퇴직금제도는 후불적 임금의 성격도 있으며 사회보장적 임금의 성격이라는 이중적 가치가 있다. 더 나아가서 퇴직금제도가 사회보장적 임금의 성격으로 볼 때 이주노동자가 그들의 모국으로 출국할 것을 조건으로 강제한다는 것은 헌법적 논리로 이해하기 힘들며 정책적 논리도 이해하기 힘들다. 국내 체류 중인 이주노동자가 적법한 체류자격으로 그 기간이 도래하면 그들의 모국으로 출국하는 것이 정책적 및 법적 필요성은 인정할 수 있다. 그러나 현행 관련법상 외국인근로자에게 적용하고 있는 출국만기보험제도는 정책적 필요성만으로 정당하고 합리적인 근거를 찾기 힘들며, 외국인근로자에 대한 기본권주체성과 동 보험제도의 관계에서도 권리보호의 문제가 있으므로, 이에 대한 문제점을 본 연구논문에서는 동 제도의 도입배경, 내용 및 그 성격에 있어서 외국인근로자의 권리보호와 그 방안을 찾고자 한다.
Abstract
The issue that interests foreign workers most recently in Korea is when to pay the departure insurance premium. First, under the employment permit system, foreign workers or their users are required to purchase four insurance policies. They are departure insurance, return cost insurance, guarantee insurance, and insurance for foreign workers. This research paper discusses departure maturity insurance. Under the current law, departure insurance is required to be paid within 14 days after foreigners 'exit' and it is questionable whether it is legally legal to link retirement payments with exports for policy purposes such as rooting out illegal residency. Retirement is originally a legal nature, and it also has a social security benefit. Thus, as with wages, payments are legally guaranteed within 14 days of the termination of the labor relationship, which has nothing to do with the status of the worker or his or her stay status. Moreover, considering the nature of social security benefits, which both severance and retirement benefits, it is more unlawful to bind a foreign worker's return to his home country as a condition for the payment. Although there may be a policy need to send back foreign workers whose stay period has passed to their home country, the current departure insurance system discriminates against foreign workers based on their policy needs, and it also harms the law of retirement
