시민들은 선거에 참여할 도덕적 의무를 지는가?

한국을 포함하여 많은 민주주의 국가에서 전국 단위 선거의 투표율이 지속적으로 하락하는 것을 경험하고 있다. 이에 대한 대응책으로 일부 법이론가나 정치이론가들은 의무적 선거 참여 제도를 도입할 것을 강력히 요구하지만 그에 대한 반론도 만만치 않은 상황이다. 이와 관련하여 한 가지 중요한 쟁점은 과연 시민들이 선거에 참여할 도덕적 의무를 지는지 여부이다. 왜냐하면 일단 시민들이 그러한 도덕적 의무를 진다고 가정할 때 우리는 의무적 선거 참여 제도에 대한 가장 직접적이고 이론의 여지가 적은 정당화를 획득하게 될 것이기 때문이다. 브래넌(G. Brennan)과 로마스키(L. Lomasky)의 논문 “Is There A Duty to Vote?”는 시민들이 선거에 참여할 도덕적 의무를 지는지에 대한 고전적인 논문이다. 그 논문에서 브래넌과 로마스키는 그러한 의무를 정당화할 수 있는 다양한 논증을 검토하고, 그 논증들이 모두 타당하지 않다는 결론으로 나아간다. 그들이 검토한 논증 중 가장 흥미로운 논증이 소위 일반화로부터의 논증인데, 본 논문에서 필자는 이 논증의 타당성을 집중적으로 살펴볼 것이다. 그 결과 비록 그 논증이 타당하지 않다는 브래넌과 로마스키의 주장이 옳지만 그 주장을 위해 그들이 내세운 논거는 옳지 않다는 것이 밝혀질 것이다.
Abstract
Many democratic countries, including Korea, have seen a steady decline in the voter turnout in nationwide elections. As a countermeasure to this problem, some legal or political theorists emphasize the urgent need to introduce a system of compulsory voting, but this is resisted by others. One important talking point in this debate is the question of whether citizens have the moral duty to vote. For once we assume that citizens do have the duty to vote, we will be given a pretty direct and straightforward justification for the introduction of a system of compulsory voting. G. Brennan and L. Lomasky’s “Is There A Duty to Vote?” is a classic paper on this issue. Brennan and Lomasky there examine a variety of arguments for the duty to vote, and conclude that they are all invalid. The most interesting argument among them is the so-called ‘argument from generalization’. In this paper, I will bring this argument under close scrutiny. The upshot will be that Brennan and Lomasky’s thesis that the argument from generalization is invalid is well-taken, but the reason they give for this thesis is a bad one.
