현대무도 현장의 안전사고와 민사책임:불법행위 책임을 중심으로

This study is to search for the legal principles of the civil liability on the negligent accidents at the martial arts fields on the present days. For the purpose of the study, as a method of the reinterpretation about doctrinal interpretation and authoritative interpretation. I have gathered and analysed literatures related legal provisions, law-cases and etc on the base of the civil liability. There are two types of negligent accidents at the martial arts fields on the today. One is the human factor and the other is facility factor. The civil liabilities are classified as a general illegal act on the article 750 and special illegal act on the article 756 or 758 according to the requirements. At the case of the general illegal act the attacker undertakes civil liability for the injured party by the article 750. At the case of the general illegal act the employer or manager undertakes responsibility by the article 756 and the possessor or owner of structures undertakes civil liability for the injured party by the article 758. At the time the negligent accidents occurred it is desirable to settle a dispute autonomically through the internal consultation at the martial arts fields. But it is difficult to settle the dispute autonomically they must to settle through the legal dispute. For the speedy recovery of the injured party We need follow-up study about criminal liability and state tort liability in this field also.
