한국 국제가족법의 회고와 과제

The purpose of this paper is twofold. One is to look back on the developments of doctrines and precedents since the revision of the 2001 International Family Law in Korea. Another is to present the challenges of the current Korean International Family Law. First, I reviewed the doctrines and precedents of the International Family Law in Korea, and found unfortunately that there was no abundant result in them. Next, my thoughts on the challenges of the Korean International Family Law are as follows; Firstly, there is a need to take more active consideration of the human rights issue in the Korean International Family Law. Secondly, Korean International Family Law should pay more attention to changes in family relations in modern society. Thirdly, it is necessary to enter into the Hague Conventions on International Family Law for international cooperation. Fourthly, attention should be paid to the change of the connecting factors in the International Family Law in Europe. Fifthly, it is necessary to study deeply the concept of the habitual residence in the international family law. Sixthly, it is necessary to review the Hague Protocol of 2007 on the Law Applicable to Maintenance Obligations. Seventhly, we need to reconsider the law applicable to name. Eighthly, in the international adoption, it is necessary to study the applicable law when a couple adopts children.
