초록
오늘날 행정심판의 기능 중 행정의 ‘자기통제’의 의미에서 ‘부당성심사’는 어떤 의미를 가지고 있는가. 본고는 행정의 ‘자기통제’란 어떤 의미인가, 제3자화되어 강한 독립성을 가지는 행정심판위원회가 하는 심판도 과연 진정한 의미에서의 ‘자기통제’라고 할 수 있는가, 재량을 심사할 때 행정심판위원회는 법원과는 다른 판단능력이 요구되는 것인가, 또 다른 한편으로는, ‘부당’과 ‘위법’은 구별가능한 개념인가, 양자는 질적인 차이인가 정도의 차이인가, 즉 법원이 심사할 수 없는 부분을 말하는 것인가 단지 ‘위법’에는 이르지 않는 부분을 말하는 것인가 하는 등과 같은 질문에 대한 나름의 고찰이다. 부당에 대한 판단은 결국 공익에 대한 판단으로 이어지는 것이고 이것은 대립하는 가치 중에서 어떤 것을 선택해야 하는가, 그러기 위해서는 어떤 절차나 수단을 선택해야 하는가, 그리고 도대체 누가 판단해야 하는가가 쟁점이 될 것이다. 또 이러한 점들은 심사기관의 구성이나 그 심리방식을 생각하는데 있어서 고려되어야 할 것이다.
Abstract
While Administrative Appeals System in Korea simultaneously possesses both remedy of violation of rights for its citizens and due operation of administration, there is growing opinion that it places too much weight on the former. Thus, in order to keep the balance between the two, it is necessary, more than anything else, to look into what meaning ‘self-control’ of the administration has in the appeals function called due operation of administration and to review what meaning ‘injustice evaluation’ has in ‘self-control.’ That is, today when the aspects of specialty, technicality, independence and fairness of administrative appeals are viewed as significant, this essay is a reflection on such questions as “What does ‘self-control’ in administration mean?”, “Can the judgements of the Administrative Appeals Committee which has strong independence as a 3rd party be rightly considered as ‘self-control’ in the true sense of the word?” and “Is Administrative Appeals Committee required to have different judgement ability from that of the court when they evaluate discretion?” and, in another perspective, “Is the concept ‘injustice’ distinguishable from ‘illegality’?” and “Are these two concepts different either inquality or inquantity?, or, Does injustice mean the part which cannot be judged by the court or just the part which does not reach the degree of ‘illegality’?” Judgement on injustice ultimately means judgement on public interest and, here, disputes may arise on what we should choose among conflicting values, which procedures and means we should choose and who should make judgments. In additions, these questions need to be considered in constituting appeals institutions and drawing out the means of evaluation.
