사법제도개혁에 따른 일본 법교육의 변화 - 재판원제도와 관련된 내용을 중심으로 -

In this paper, I examined the changes, the contents, and the implication of Japanese law-related education in relation to the enactment of Court Member Act that was the core of the 21st judicial system reform in Japan. The prominent feature of Japanese law-related education is that it envisaged the linkage of the law-related education with implementation of the court member system. Citizens’participation in the trial system was suggested as a means of recovering confidence in judicial process and the law-related education was designed to provide the firm basis for that. Japanese MOJ(Ministry of Justice) and MEXT(Ministry of Education, Culture, Sports, Science and Technology) were mainly responsible for the production of law-related education materials. MOJ’s materials drew up details of law-related education, including the court member system in line with the organization of MEXT’s guidelines for teaching, and the latter presented the direction of course structure and education contents that reflected the former again. As experience in implementing the court member system has accumulated, more realistic and familiar law-related education materials have been produced recently. Despite such careful preparations, however, Japanese law-related education is still presented with tasks such as raising interest in law-related education, training of sufficient law-related education personnel, connection of education experts and legal experts, and developing appropriate teaching materials. In addition, the further consideration on law-related education related to the court member system is required from the perspective of human rights, democracy, and popular sovereignty.
