배달 조건부 수색・압수・검증 영장의 도입 제안

이 논문에서 필자는 대한민국의 수사기관이 사전 수색・압수・검증 영장(이하 ‘수색 영장’으로 약칭함)을 발부받아 적법하게 통제배달을 수행하려고 시도할 때 지방법원 판사를 설득하여 사전영장을 발부받으려면 어떤 대비를 하여야 하는가 하는 문제를 고민・검토하는 사전 정지작업으로 미국의 장래 수색 영장 경험을 개관하고 한국에서의 벤치마킹 방안을 검토하였다. 이미 1970년대 이전부터 미국의 여러 주(states)에서 통제배달이 수사에 활용되었고 각 주마다 다양하고 고유한 판례들이 축적되었다. 그러다가 2006년에 미국 연방대법원이 통제배달에 활용된 이른바 ‘장래 수색 영장(anticipatory search warrant)’의 합헌성을 선언하였다. Ⅱ.에서는 이 판결을 자세히 소개하였다. 다음에 대한민국의 수사기관이 사전 수색 영장을 청구하여 통제배달을 시도하려 할 때 가장 먼저 부딪히는 문제는 피의자를 어떻게 특정할 것인가 하는 문제이다. 따라서 Ⅲ.에서는 이 문제에 힌트를 줄 수 있을 만한 2008년의 일리노이 주 항소법원 판결을 발굴하여 자세히 소개하였다. Ⅳ.에서는 2008년의 일리노이 주 항소법원 판결을 벤치마킹하여 한국에서의 배달 조건부 수색・압수・검증 영장 도입을 제안하였다.
Abstract
What kind of preparations should be done to persuade a judge of a local court to issue a kind of anticipatory search warrant when the investigation agency in South Korea is seeking a prior warrant for search, seizure and verification (hereinafter referred to as a ‘search warrant’)? To answer this question, I summarized the American type anticipatory search warrant discourse and discussed a kind of benchmarking ways in South Korea. Since the 1950s, controlled delivery has been used in various states in the United States, and various and unique cases have been accumulated in each state. In 2006, the Supreme Court of the United States recognized the constitutionality of the anticipatory search warrant which has been used in controlled delivery matters. In part II, I summarized the decision in great detail. The first question which South Korea's investigative agencies face is the problem that how to specify the suspect. A decision of an appellate Court of Illinois can be very helpful. Therefore, in part III I introduced the decision in detail. In part IV, I discussed how to benchmark the ruling of the Illinois state appeals court and proposed the adoption and adaptation of it into South Korea.
