장애인 등록에 대한 특별행정심판 설치의 필요성

초록
먼저 장애인 등록과 관련하여 현행 행정심판제도가 자기통제기능, 권리구제기능, 부담경감기능을 다하고 있는가를 통계를 통해 살펴보았다. 그 결과 현행 17개 시‧도 행정심판위원회 중 절반이 넘는 9개 행정심판위원회가 그 기능을 제대로 하고 있지 못하고 있는 것으로 나타났다. 이러한 문제점이 드러난 이유는 현행 행정심판위원들이 의학적 판단능력이 부족하거나 전무하다는 점, 의학적 판단을 위한 감정절차를 강제할 방법이 존재하지 아니하다는 점 등을 들 수 있다. 이를 개선하기 위해서는 특별행정심판을 설치하는 것이 필요한데 특별행정심판을 설치하기 위한 행정심판법상의 요건을 살펴본 결과 그 요건을 충족하는 것으로 평가되었다. 특별행정심판을 설치하는 경우 그 위원회에 의사가 포함되어야 하고, 신속한 감정절차가 이루어져야 하며 장애판정의 전국적 통일성을 위해 전국적 차원에서 신설되어야 하는 내용으로 장애인복지법이 개정되는 방향으로 이루어져야 한다고 본다. 현 정부가 도입하고자 하는 종합판정도구 제도가 시행되더라도 특별행정심판을 설치될 필요가 있고, 그 경우 의사 외에 사회‧환경적 장애전문가가 위원으로 참여할 수 있어야 할 것이다.
Abstract
I studied that the administrative appeals system about registration of persons with disabilities functions properly, or not, by data. As a result, 9 administrative appeals among 17 regional administrative appeals do not function properly. The reasons are that the administrative appeals committee members lack or have not medical understanding, and that there is not obligatory estimation system for medical decision, etc. * Professor, Chungnam National University Law School In order to improve these problems, it is necessary to organize new administrative appeals system for registration of persons with disabilities. To organize new administrative appeals system, Administrative Appeals Act requires 'the extraordinary and exceptional nature of a specific case'. I concluded that the cases about registration of persons with disabilities fulfill the requirement. In case of organizing a new administrative appeals system for registration of persons with disabilities, it is needed that the administrative appeals committee includes 2~3 doctors for medical decision, that the administrative appeals committee prepare speedy estimation procedure for medical decision, and that the administrative appeals committee is organized nationally, not regionally.
