국가에 의한 국제제도의 전략적 활용: 자본시장통합법 시행사례를 중심으로

2008년 금융위기 이후 위기 해결을 위해 금융시장을 규제하려는 국제적 공조가 각국에 요구되었으나 한국은 오히려 국내 금융시장을 개방하기 위해 기존의금융관계법을 통폐합한 제도 즉 자본시장통합법을 시행하고자 했다. 금융위기 발발 이전, 한국은 국내 금융시장의 경쟁력을 강화하는 것을 목표로설정하였다. 또한 이를 거시적인 목표로 하여 금융시장의 진입장벽을 낮추고, 외국의 대형 금융회사와 견줄 수 있는 금융투자회사를 육성하고자 했다. 이를 위해자본시장통합법을 2007년 제정하였으며 2009년에 시행하고자 했다. 그러나 제도 시행을 앞두고 금융시장을 규제하자는 대내외적 압력이 있었다. 이에 한국정부는 예정대로 제도를 시행하기 위해 규제적 성격의 국제제도를 수용하여 국내제도에 적용하였다. 이렇게 본다면 국가가 주도하는 금융제도 변화과정은 제도 외적 조건에 수동적으로 영향을 받은 것처럼 보인다. 하지만 본 연구에서는 국가가 금융시장에 대해 설정한 명백한 목표가 있었기때문에 오히려 국가가 국제제도를 적극 수용하고 활용한 것임을 주장한다. 즉 국가는 국내 금융시장 개방을 위해 제도변화 반대연합을 타파하기 위한 수단으로국제제도를 전략적으로 활용한 것이다.
Abstract
Korean government tried to implement, as scheduled, ‘Financial Investment Services and Capital Market Act,’ which aimed to deregulate the financial sector leading to the financial market liberalization, even though there were increased international cooperative efforts to regulate the financial markets after the 2008 financial crisis. Korean government had set the goal of enhancing the financial market competitiveness by lowering the entry barrier into the financial market as well as deconstructing the firewalls of various financial sectors, which will lead to the establishment of financial giants which can compete with global financial giants. Because of the 2008 financial crisis, there were intense domestic oppositions to the scheduled implementation. From the start, government has set the clear goal of the policy, that is, enhancing the Korean financial market competitiveness and has succeeded in implementing the Act as scheduled. In persuading and dismantling the opposition coalition, government has employed the strategy of utilizing the international institution.
