1865년 미국 선교사로 중국에 온 윌리엄 마틴(William Alexander Martin,1827-1916)은 헨리 휘튼(Henry Wheaton,1785-1848)이 저술한 『국제법원리』(Elements of International Law with a Sketch of the History of the Subject)를 총리각국사무아문의 찬조를 받아 중국어로 번역하여 『만국공법』이라는 제목으로 출간하였다. 『만국공법』이 출간된 이후 국제법과 국제질서에 대한 이해를 비롯하여, 법치, 권리, 주권, 민주공화 등등 서양의 생소한 개념들이 청의 지식인들에게 알려지게 되었다. 『만국공법』이 청 정부의 전통적 인식의 변화를 가져온 것은 분명하지만, 예(禮)를 바탕으로 한 위계적 질서로 주변국가를 바라보던 중국의 도덕적 이해는 변함이 없었다. 그것은 휘튼의 원저에는 없었던 내용들을 삽입하거나 수정하면서 사용되었던 천(天), 화(和), 공(公), 리(理) 등의 중국의 전통적 개념들에서 잘 드러난다. 이것은 중국을 더 이상 천조국이 아니라 만국의 하나로 받아들여야 하는 현실에서 여전히 지키고자 했던 중국적 자존심이며, 정체성이었다고 할 수 있다.
Abstract
In the late of Qing Dynasty, American missionary William Alexander Martin(1827- 1916) translated Henry Wheaton(1785-1848)’s “Elements of International Law with a Sketch of the History of the Subject” into “Wanguogongfa(萬國公法)”(1865). Since its publication, the Western concepts such as the rule of law, right, sovereignty, democratic republic, etc. as well as the international law and the international order became known to the intellectuals of Qing. It was clear that this had brought about a change in the traditional perception of the Qing government and its intellectual society, but the moral understanding of China, which viewed the neighboring countries with a hierarchical order based on ‘li(禮)’, had not changed. It was evident in traditional Chinese concepts such as Tian(天), He(和), Gong(公), and li(理), which were used in inserting or modifying contents that were not found in Wheaton’s original work. This is a Chinese pride and identity that they still wanted to protect China from the reality of accepting China as one of the nations, not the Kingdom of the Heaven that could make law and order for surrounding countries and for itself.
