도시정비 및 재생사업의 최근 현황과 발전 과제

2013. 6. 도시재생기본법이 제정되었지만 그동안 도시재생사업은 크게 활성화되지 못한 것이 사실이다. 도시재생사업은 사업 관계자인 국가, 지자체, 사업시행자, 해당 지역 주민 등의 적극적인 참여와 협력 하에 도시재생기본법이 규정한 여러 사업과 방식을 실제 구현할 수 있는 정부와 지자체의 사업수행 의지가 매우중요하다. 또한, 단기적으로는 종래 도시정비 및 재생사업 관련 다양한 법제도상의 사업방식도 존종하여 도시정비와 도시재생 관련 사업 상호간에 사전 협의와조정을 통해 사업 추진의 정합성을 확보할 필요가 있고, 장기적으로는 도시정비및 재생사업 관련 전국 단위의 기본계획을 하나로 통합하여 효율성과 추진력을극대화하는 방식으로 나아감이 상당하다. 이를 위해, 관련 행정제도와 법제를 통폐합하는 것이 가장 중요하다. 나아가, 도시재생기본법상의 도시재생기획단을 실제 운영하여 전국 단위의 도시정비 및 재생사업에 관한 상시 업무조정 기능을 수행하는 한편, 현재 국무총리 소속인 도시재생특별위원회를 ‘지역균형발전위원회’ 처럼 대통령 소속으로 격상하고, 그 기능과 권한 역시 단순 심의위원회에서 행정위원회로 격상하여 집행기능을 보다 강화하여야 한다. 또한, 예산과 재정의 통합도 중요한데, 국토교통부 내 도시정비 및 재생사업 관련 예산을 하나로 통합 운영하는 한편, 특정 지역의 신속한 사업추진을 위해 포괄보조금제도도 도입할 필요가 있다. 무엇보다, 현행과 같은 계획수립비, 용역비 등의 일회성 지원에서 벗어나 사업의 실질적 촉진을 유도할 수 있는 재원방안을 마련하여 예산이 효율적이고도 선순환적으로 사용되는 구조를 만들어야 한다. 마지막으로 현행 도시재생기본법 제28조에서 규정하고 있는 특별 재원을 실제 마련하여 사업부진 지역에대한 현실적 지원을 하는 한편, 도시재생사업에 민간투자와 지역 주민의 참여도적극 유도하여 사업성을 내실화할 필요가 있다.
Abstract
Since the establishment of the Urban Regeneration Act. it is true that the urban renewal business has not been greatly activated. It is more important than ever for the government to carry out the projects and the ways in which the city revitalization project has been implemented by the actors of the city revitalization project, ie, the state, local governments, project developers, local residents etc. In the short term, it is necessary to recognize the existence of various laws and systems related to the existing city maintenance and rehabilitation projects, and to ensure the consistency of the project through prior consultation and adjustment between related projects. In the long term, It is significant to integrate and operate the basic plan of the unit. To accomplish this, the related administrative system and legislative system are integrated and the nominal city regeneration planning team is actually installed and operated to carry out the business coordination function at all times. At the same time, the Urban Regeneration Special Committee, And the function should also be upgraded from the role of a simple deliberation committee to the administrative committee to strengthen the executive function. In addition, integration of budget and finances is most important. It is necessary to integrate the budgets of urban renewal and rehabilitation projects in the Ministry of Land, Transport and Maritime Affairs and to introduce a comprehensive subsidy system in order to promptly carry out projects in specific areas. Above all, it is necessary to create a structure that can be utilized efficiently and in a virtuous cycle by providing financial resources that can induce substantial promotion of business by avoiding one-time support such as planning fee and service fee. Finally, it is necessary to provide practical support for the poor areas of the project by providing the special fund provided in the Article 28 of the current Basic Law on Urban Regeneration, and to plan to utilize private investment and local residents' participation in the urban regeneration project.
